On Tuesday, Dustin Wall appeared in the 22nd Judicial District for his return filing of charges after being arrested last week on a warrant.

Though Wall’s return filing of charges took place in Chief Judge Todd Plewe’s courtroom, Judge Leslie Gerbracht, a judge in the 3rd Judicial District, stood in for Plewe, who was unable to be present.

Wall, who is no longer being held in custody, appeared with defense attorney Richard Sims. Sims told Gerbracht that they wished to waive advisement and move straight to the preliminary hearing and pretrial conference, which had already been set for the end of April.

Wall was also given a protection order at his court appearance on Wednesday, April 3, according to District Attorney Christian Hatfield.

On Monday, April 1, Wall was taken into custody on warrant after he was reported by a 911 caller from outside the Cortez Apartments on Empire Street.

After police arrived on scene, they woke Wall and took him into custody without incident.

Police had been seeking Wall after an incident in the City Market parking lot in February, where Wall is suspected to have attacked a woman and threatened her with a firearm.

Wall allegedly hit the woman over the head twice with the firearm before fleeing the scene.

His next appearance will take place Tuesday, April 30, for his 10 a.m. appearance on bond and pretrial conference. On May 3, he will have a preliminary hearing at 10 a.m.

As of this writing, a trial date has not been posted on the Montezuma County Court Docket website.
