A Shiprock man with seven DUI convictions in New Mexico and two in Colorado was arrested on a DUI in Cortez on Dec. 23.<\/p>\n

Perry Hayes Jr., 47, allegedly had an open case of Budweiser in the backseat of a Kia sedan when Cortez Police initiated a traffic stop about 12:30 a.m. on South Elm Street near the intersection with Main Street. He did not perform roadside maneuvers adequately and, at Montezuma County Detention Center, blew a blood alcohol level of 0.159 percent, which is above the legal limit of 0.08 percent.<\/p>\n

In court on Christmas Eve, prosecutors recommended a $20,000 cash or surety bond, but 22nd Judicial District Judge Todd Plewe set bond at $3,000 cash or surety. He returned to court, via video from jail, on Thursday.<\/p>\n

Public defender Justin Bogan on Thursday requested a lower bond. He said Perry\u2019s father has health issues and he needs to take care of him. Montezuma County Court Judge JenniLynn Lawrence denied the bond request.<\/p>\n

\u201cI encourage you to reach out to other folks who can help your dad if you\u2019re unable to post the bond,\u201d Lawrence said.<\/p>\n

Hayes is charged with a Class 4 felony for driving under the influence with three or more priors as well as failure to stop at a red light, unlawful display of license plates and driving under restraint. He is scheduled for a preliminary hearing on Jan. 23.<\/p>\n
