{"id":93868,"date":"2019-05-21T17:30:20","date_gmt":"2019-05-21T23:30:20","guid":{"rendered":"https:\/\/dh.durangoherald.com\/tj\/sexual-assault-case-declared-mistrial\/"},"modified":"2019-05-21T17:30:20","modified_gmt":"2019-05-21T23:30:20","slug":"sexual-assault-case-declared-mistrial","status":"publish","type":"post","link":"https:\/\/dh.durangoherald.com\/tj\/sexual-assault-case-declared-mistrial\/","title":{"rendered":"Sexual assault case declared mistrial"},"content":{"rendered":"\n<p><figure class=\"wp-block-image naviga-inline-image naviga-align-left alignleft\"><img decoding=\"async\" src=\"https:\/\/imengine.public.prod.dur.navigacloud.com\/?uuid=c4316091-ca85-4007-93de-1c14f50d5537&amp;function=cover&amp;type=preview&amp;source=false&amp;width=2000\" width=\"1000\" height=\"1333\" alt=\"Bond\" class=\"naviga-image\" loading=\"lazy\"><figcaption><span class=\"caption\">Bond<\/span><span class=\"credit\">du1-i-syn<\/span><\/figcaption><\/figure>\n<\/p><p>A 12-person jury could not reach a unanimous decision this week in a sexual assault trial, the latest twist in a gang rape case that also resulted in an overturned conviction.<\/p>\n<p>Six men and six women said Tuesday they were deadlocked after the weeklong trial of Devin Bond, a 22-year-old Durango man who police and prosecutors said sexually assaulted a woman at gunpoint.<\/p>\n<p>District Court Judge William Herringer declared a mistrial around 3 p.m. Tuesday after jurors sent him a letter saying they were \u201chopelessly deadlocked,\u201d he said. Jurors had been deliberating since about noon Monday. Several jurors declined to comment Tuesday as they left the La Plata County Courthouse.<\/p>\n<p>Bond, who did not testify in his own defense, showed no obvious reaction to Tuesday\u2019s mistrial ruling. A hung jury essentially sends the 2017 case back to square one.<\/p>\n<p>Bond is scheduled to appear Friday morning in Herringer\u2019s courtroom for a hearing to set another court date. Deputy District Attorney Sean Murray said prosecutors hope to have a decision by the end of the week about whether they plan to retry the case.<\/p>\n<p>Bond is accused of sexually assaulting a woman on the night of Oct. 14, 2017, with two other co-defendants, James Zink and Anthony Fitts.<\/p>\n<p>Bond\u2019s Durango defense lawyers Brian Schowalter and Katie Whitney maintained in closing arguments Monday that Bond had consensual sex with the woman and that her story of what happened on the night in question has not been consistent.<\/p>\n<p>\u201c(The woman\u2019s) story is totally off the rails,\u201d Whitney told jurors. \u201cIt changes as we go.\u201d<\/p>\n<p>The woman initially told investigators all three men were strangers that \u201cgang raped\u201d her at gunpoint, Whitney said. But in subsequent interviews with authorities, Whitney said it came to light that the woman knew the men and had engaged in consensual sex.<\/p>\n<p>Fitts, who previously pleaded guilty and was sentenced to six years in prison,  <a href=\"https:\/\/durangoherald.com\/articles\/277238\">had his conviction overturned last week after the woman testified<\/a> at Bond\u2019s trial that the sex between her and Fitts was consensual.<\/p>\n<p>But Murray said the sex was no longer consensual once Zink threatened the woman with a gun. At this point in the night, authorities say Fitts was no longer in the car.<\/p>\n<p>Zink ordered the woman to perform sexual acts or be shot, Murray said.<\/p>\n<p>\u201cIf this was consensual sex, why the gun?\u201d he told jurors.<\/p>\n<p><a href=\"https:\/\/durangoherald.com\/articles\/239250\">Zink, who pleaded guilty, received 14 years in prison<\/a> and 10 years of probation.<\/p>\n<p>Bond told investigators a shotgun was in the car, and that Zink racked it. But Bond\u2019s attorneys say there was no serious threat of shooting her. Prosecutors, however, said it\u2019s clear the woman feared for her life.<\/p>\n<p>\u201cYou can\u2019t threaten someone with a gun in exchange for sexual acts and claim it was consensual,\u201d Murray said. \u201cThat doesn\u2019t make any sense.\u201d<\/p>\n<p>Whitney criticized investigators with the Durango Police Department for \u201cwillful ignorance\u201d for not thoroughly vetting the woman\u2019s account of what happened that evening, calling it a \u201cbig, sensationalized\u201d story.
