Although nothing was found then, prosecutors are relying, in part, on cadaver dog evidence to convict Mark Redwine of second-degree murder.<\/span><span class=\"credit\">Jerry McBride\/Durango Herald file<\/span><\/figcaption><\/figure>\n<\/p><p>A judge overseeing the trial of Mark Redwine, a Vallecito man accused of killing his 13-year-old son, Dylan, upheld a decision this week to allow evidence obtained by sniffing dogs at trial, despite the defense\u2019s argument that such evidence is unscientific and unreliable.<\/p>\n<p><figure class=\"wp-block-image naviga-inline-image naviga-align-left alignleft\"><img decoding=\"async\" src=\"https:\/\/imengine.public.prod.dur.navigacloud.com\/?uuid=75d512be-b988-4ba3-9dba-2175d9e51173&amp;function=cover&amp;type=preview&amp;source=false&amp;width=2000\" width=\"1611\" height=\"2211\" alt=\"Dylan\" class=\"naviga-image\" loading=\"lazy\"><figcaption><span class=\"caption\">Dylan<\/span><span class=\"credit\">du1-i-syn<\/span><\/figcaption><\/figure>\n<\/p><p>Evidence obtained by canines and their handlers trained to detect human remains may be presented as factual, expert testimony at a four-week September trial where prosecutors will work to prove beyond a reasonable doubt that Redwine killed his son in November 2012. Attorneys working on the Redwine trial are barred from speaking about the case by court order.<\/p>\n<p>Sixth Judicial District Court Judge Jeffery Wilson said in an order Monday that <a href=\"https:\/\/durangoherald.com\/articles\/273928\">the defense\u2019s latest attempt to exclude cadaver dog evidence<\/a><a href=\"https:\/\/www.courts.state.co.us\/userfiles\/file\/Court_Probation\/06th_Judicial_District\/La_Plata\/Redwine\/Order%20Regarding%20Supplemental%20Brief%20on%20the%20Use%20of%20Cadaver%20Dogs%20D-109.pdf\" target=\"_blank\" rel=\"noopener\">did not convince him<\/a> to change <a href=\"https:\/\/www.courts.state.co.us\/userfiles\/file\/Court_Probation\/06th_Judicial_District\/La_Plata\/Redwine\/Order%20Regarding%20the%20Dog-Sniff%20Evidence%20D-36%2C%20D-37%2C%20D-38%2C%20D-39%2C%20D-40%2C%20and%20P-14.pdf\" target=\"_blank\" rel=\"noopener\">an order he\u2019d already issued<\/a> citing a Colorado Supreme Court case where justices admitted evidence obtained by canines and their handlers as expert testimony.<\/p>\n<p><figure class=\"wp-block-image naviga-inline-image\"><img decoding=\"async\" src=\"https:\/\/imengine.public.prod.dur.navigacloud.com\/?uuid=4efa12e0-2b75-406f-adf5-78e505590e51&amp;function=cover&amp;type=preview&amp;source=false&amp;width=2000\" alt=\"Sixth Judicial District Court Chief Judge Jeffrey Wilson listens during Mark Redwine\u2019s advisement hearing at the La Plata County Courthouse.\" class=\"naviga-image\" loading=\"lazy\"><figcaption><span class=\"caption\">Sixth Judicial District Court Chief Judge Jeffrey Wilson listens during Mark Redwine\u2019s advisement hearing at the La Plata County Courthouse.<\/span><span class=\"credit\">Jerry McBride\/Durango Herald file<\/span><\/figcaption><\/figure>\n<\/p><p>Wilson said in his order that he will allow the defense team to present further arguments and evidence at an upcoming motions hearing about why cadaver dog evidence shouldn\u2019t be allowed at trial. Public defenders previously submitted a 39-page motion, written by The Innocence Project and signed by defense attorney John Moran, arguing that evidence obtained by cadaver dogs does not rise to the reliability required by the court for scientific evidence.<\/p>\n<p>Prosecutors, in part, hinge their case on the fact that cadaver dogs \u201cindicated that a deceased person had been in (Redwine\u2019s) living room and bed of his pickup truck \u2026,\u201d according to <a href=\"https:\/\/durangoherald.com\/articles\/174572\">the indictment<\/a>.<\/p>\n<p>\u201cWhat is at issue is what has never been proven with any degree of scientific reliability: the ability of a dog to detect the residual scent of a particular object, including human remains, at a specific location days, weeks, months or even more than a year after that object was removed,\u201d The Innocence Project wrote in its motion signed by Moran. \u201cYet, that is precisely the speculative theory upon which the state seeks to base its case against Mr. Redwine.\u201d<\/p>\n<p>Dylan Redwine disappeared from his father\u2019s home in November 2012 in Vallecito. <a href=\"https:\/\/durangoherald.com\/articles\/47463-dylan-redwines-remains-found\">His partial remains were found<\/a> in June 2013 on Middle Mountain. His death was ruled a homicide.<\/p>\n<p>Mark Redwine has maintained his innocence ever since. He has been charged with second-degree murder and child abuse resulting in death.
