{"id":93742,"date":"2019-05-31T18:35:13","date_gmt":"2019-06-01T00:35:13","guid":{"rendered":"https:\/\/dh.durangoherald.com\/tj\/trial-date-set-in-lawsuit-accusing-durango-train-of-starting-416-fire\/"},"modified":"2019-05-31T18:35:13","modified_gmt":"2019-06-01T00:35:13","slug":"trial-date-set-in-lawsuit-accusing-durango-train-of-starting-416-fire","status":"publish","type":"post","link":"https:\/\/dh.durangoherald.com\/tj\/trial-date-set-in-lawsuit-accusing-durango-train-of-starting-416-fire\/","title":{"rendered":"Trial date set in lawsuit accusing Durango train of starting 416 Fire"},"content":{"rendered":"\n<p>A trial date has been set in the lawsuit filed by residents and business owners against the Durango &amp; Silverton Narrow Gauge Railroad, which they accuse of starting the 416 Fire.<\/p>\n<p>The lawsuit, <a href=\"https:\/\/durangoherald.com\/articles\/240659\">filed in September 2018<\/a>, contends that the 416 Fire, which sparked June 1, 2018, about 10 miles north of Durango, was started by a cinder emitted from the train\u2019s coal-fired steam engine while traveling north on the 50-mile route from Durango to Silverton.<\/p>\n<p>To date, the U.S. Forest Service has not named an official cause of the fire, calling the investigation \u201copen and active.\u201d Witness accounts, however, have fueled speculation the D&amp;SNG was at fault.<\/p>\n<p><figure class=\"wp-block-image naviga-inline-image\"><img decoding=\"async\" src=\"https:\/\/imengine.public.prod.dur.navigacloud.com\/?uuid=51ac4e21-1527-40e4-aef5-d52b07d36597&amp;function=cover&amp;type=preview&amp;source=false&amp;width=2000\" width=\"1200\" height=\"783\" alt=\"\" class=\"naviga-image\" loading=\"lazy\"><figcaption><span class=\"credit\">du1-i-syn<\/span><\/figcaption><\/figure>\n<\/p><p>Sixth Judicial District Court Judge Suzanne Carlson set a seven-week jury trial to begin Sept. 14, 2020.<\/p>\n<p>In Friday\u2019s court hearing, it was acknowledged there will be complications selecting a jury for a seven-week trial. The sheer number of affected people listed in the lawsuit is expected to draw out court proceedings.<\/p>\n<p>D&amp;SNG owner Al Harper attended Friday\u2019s court hearing.<\/p>\n<p>Earlier this year, the court ordered <a href=\"https:\/\/durangoherald.com\/articles\/257160\">documents associated with the case to be suppressed<\/a>, meaning only lawyers and the court may view them. As a result, many of the case filings are not public.<\/p>\n<p>More than 26 affected parties are listed in the lawsuit who seek compensation for damages as a result of the 416 Fire.
