{"id":93391,"date":"2019-06-19T01:06:20","date_gmt":"2019-06-19T01:06:20","guid":{"rendered":"https:\/\/dh.durangoherald.com\/tj\/court-montezuma-county-will-pay-to-replace-culvert\/"},"modified":"2019-06-19T01:06:20","modified_gmt":"2019-06-19T01:06:20","slug":"court-montezuma-county-will-pay-to-replace-culvert","status":"publish","type":"post","link":"https:\/\/dh.durangoherald.com\/tj\/court-montezuma-county-will-pay-to-replace-culvert\/","title":{"rendered":"Court: Montezuma County will pay to replace culvert"},"content":{"rendered":"\n<p><figure class=\"wp-block-image naviga-inline-image\"><img decoding=\"async\" src=\"https:\/\/imengine.public.prod.dur.navigacloud.com\/?uuid=67ab449e-5c7d-427a-9bbb-6c8b9da6fe41&amp;function=cover&amp;type=preview&amp;source=false&amp;width=2000\" width=\"1200\" height=\"783\" alt=\"\" class=\"naviga-image\" loading=\"lazy\"><figcaption><span class=\"credit\">du1-i-syn<\/span><\/figcaption><\/figure>\n<\/p><p>Montezuma County is responsible for paying to replace a $10,000 culvert under a county road that is relied on by the Montezuma Valley Irrigation Co., according to a June 17 ruling by 22nd Judicial District Judge Douglas Walker.<\/p>\n<p>In 2018, the county purchased the new culvert from Skyline Steel, and county employees installed it. The culvert conveys water under County Road W to MVIC shareholders.<\/p>\n<p>The county requested MVIC help pay for the costs, but the privately owned water company refused, claiming state statute obligates the county to replace it if needed.<\/p>\n<p>In a complaint filed in August, MVIC requested that the court determine that the irrigation company is not obligated to reimburse the county for the cost of replacing the culvert.<\/p>\n<p>In its complaint, MVIC cites Colorado Revised Statute 37-84-106, which states bridges constructed over ditches and flumes crossing public roads shall be maintained by and at the expense of the county. Attorneys for MVIC argued that the maintenance requirement imposed by this statute includes the obligation to replace culverts.<\/p>\n<p>The county asserted that while Colorado statute states bridges constructed over ditches and flumes crossing public roads shall be maintained at the expense of the county, it does not mention replacement. The crux of the case is whether the definition of \u201cmaintenance\u201d includes replacement.<\/p>\n<p>Walker dismissed the county\u2019s claim and granted MVIC\u2019s motion for summary judgment, ruling that the state statute\u2019s language obligating county maintenance of the culvert does include replacement.<\/p>\n<p>Walker wrote that the county failed to persuade the court that its statutory \u201cmaintenance\u201d of the culvert does not include replacing a culvert.<\/p>\n<p>The county asserted that an interpretation of state law that equates maintenance and replacement was \u201cillogical and absurd,\u201d according to court documents.<\/p>\n<p>Walker disagreed. In a summary judgment, he stated the Colorado Legislature chose irrigation companies to construct the culvert, and counties to maintain them.<\/p>\n<p>\u201cThere is nothing illogical or absurd about that choice,\u201d Walker wrote. \u201cIt is equally as logical as it would be, had the legislature made one party responsible for both. Likewise, it is just as logical to include \u2018replacement\u2019 in the terms \u2018maintain\u2019 or \u2018maintenance\u2019 as to not include it.\u201d<\/p>\n<p>Walker stated that courts have previously interpreted the word \u201cmaintenance\u201d in very similar situations, \u201cand that interpretation is binding on the Court.\u201d<\/p>\n<p>\u201cBecause prior cases include the term \u2018replace\u2019 in the terms \u2018maintain\u2019 or \u2018maintenance,\u2019 the Court finds it is included as used in the relevant statutes here.\u201d<\/p>\n<p>Historically, the county and MVIC have worked together when replacing culverts, said county attorney John Baxter. In 2003, for example, MVIC installed a culvert crossing County Road 21, and the county paid $2,477 to assist with the cost.
