{"id":91226,"date":"2019-12-20T02:28:47","date_gmt":"2019-12-20T02:28:47","guid":{"rendered":"https:\/\/dh.durangoherald.com\/tj\/durango-woman-who-ran-over-cousin-sentenced-to-prison\/"},"modified":"2019-12-20T02:28:47","modified_gmt":"2019-12-20T02:28:47","slug":"durango-woman-who-ran-over-cousin-sentenced-to-prison","status":"publish","type":"post","link":"https:\/\/dh.durangoherald.com\/tj\/durango-woman-who-ran-over-cousin-sentenced-to-prison\/","title":{"rendered":"Durango woman who ran over cousin sentenced to prison"},"content":{"rendered":"\n<p>A 6th Judicial District Court judge sentenced a La Plata County woman to 10 years in prison Thursday after she admitted to running over her cousin with a truck, almost killing him.<\/p>\n<p>Katrina Baker, 28, told law enforcement the night of her arrest that she hit Arlan Vicenti, 35, \u201con purpose,\u201d a sheriff\u2019s deputy wrote in arresting documents. Prosecutors charged Baker with attempted first-degree murder, vehicular assault, driving under the influence and first-degree assault.<\/p>\n<p>Baker pleaded guilty to vehicular assault, a Class 4 felony punishable by two to six years in prison and a fine of $2,000 to $500,000. But the maximum can be as high as 12 years if a judge finds \u201cextraordinary aggravating circumstances.\u201d Prosecutors wrote in the plea agreement that Baker\u2019s five prior DUI-related convictions met the standard for a harsher sentence.<\/p>\n<p>The plea agreement capped the maximum possible sentence at 10 years.<\/p>\n<p>\u201cJust looking at the facts of this case, there\u2019s no question that you could have been convicted of attempted second-degree murder,\u201d District Court Judge Suzanne Carlson said in her sentencing order. \u201cThe maximum I can give you is 10 years \u2013 but there\u2019s an argument that it should be more.\u201d<\/p>\n<p>The incident occurred at 1:40 a.m. Dec. 30, 2018, at the Sonoco Gas Station, 28870 U.S. Highway 160 in the Grandview area, a few miles east of downtown Durango.<\/p>\n<p>A Flight for Life helicopter flew Vicenti to a hospital in Denver with internal injuries after <a href=\"https:\/\/durangoherald.com\/articles\/256855\">the crash<\/a>, including broken ribs and damage to his internal organs, according to statements made at Thursday\u2019s sentencing hearing. Vicenti, who Baker said she considered a brother, appeared in court Thursday to offer a statement.<\/p>\n<p>Arresting documents show <a href=\"https:\/\/durangoherald.com\/articles\/258102\">Baker hit her cousin with the truck over an argument about her husband<\/a>; more specifically, Vicenti said Baker deserved better. Vicenti left the courtroom Thursday before the judge imposed the sentence.<\/p>\n<p>\u201cIt is what it is, cousin. Nobody is perfect in this world,\u201d Vicenti said, wiping his eyes with a tissue. \u201cNo matter what happens, I\u2019ll always be here for you.\u201d<\/p>\n<p>Baker\u2019s attorney Jason Eley said his client has been sober for about a year and that she has since realized she caused injuries to someone she loves. But the facts of the case could constitute attempted second-degree murder, said Deputy District Attorney Sean Murray. Any sentence less than 10 years in prison \u201cdiminishes the value of human life,\u201d he said.<\/p>\n<p>\u201cShe\u2019s lucky he did not die,\u201d Murray said as Baker sobbed into her hands. Baker\u2019s mother, husband, son and friends sat in the courtroom gallery behind her.<\/p>\n<p><figure class=\"wp-block-image naviga-inline-image naviga-align-left alignleft\"><img decoding=\"async\" src=\"https:\/\/imengine.public.prod.dur.navigacloud.com\/?uuid=a1e165a1-a997-472c-b47c-072654f25e36&amp;function=cover&amp;type=preview&amp;source=false&amp;width=2000\" width=\"1000\" height=\"1333\" alt=\"Baker\" class=\"naviga-image\" loading=\"lazy\"><figcaption><span class=\"caption\">Baker<\/span><span class=\"credit\">du1-i-syn<\/span><\/figcaption><\/figure>\n<\/p><p>Baker said her tears \u201caren\u2019t for the outcome I\u2019m expecting; the tears are because I\u2019m seeing what alcohol has done to me, my family and my community.\u201d<\/p>\n<p>\u201cI have a problem and this could have been a lot worse, all due to alcohol and not being in my right state of mind,\u201d she said. Baker has two children and is five months pregnant, according to statements made at the sentencing hearing.<\/p>\n<p>Judge Carlson asked someone to take Baker\u2019s son out of the courtroom saying, \u201cYou\u2019re going to be going to prison today.\u201d Baker hugged her boy, her husband and her mother before the judge imposed sentence.<\/p>\n<p>\u201cSociety would expect that if you run someone over with a vehicle because you\u2019re angry, that you are going to go to prison for a long time,\u201d Carlson said. \u201cYou will get a chance to be with your children, but it will be a while.\u201d<\/p>\n<p>Baker wailed as the judge announced her 10-year prison sentence.
