{"id":71585,"date":"2017-02-15T03:20:56","date_gmt":"2017-02-15T10:20:56","guid":{"rendered":"https:\/\/dh.durangoherald.com\/tj\/bill-to-protect-microbreweries-receives-bipartisan-support\/"},"modified":"2017-02-15T10:20:56","modified_gmt":"2017-02-15T10:20:56","slug":"bill-to-protect-microbreweries-receives-bipartisan-support","status":"publish","type":"post","link":"https:\/\/dh.durangoherald.com\/tj\/bill-to-protect-microbreweries-receives-bipartisan-support\/","title":{"rendered":"Bill to protect microbreweries receives bipartisan support"},"content":{"rendered":"\n<p><!-- gallery:a8d5c663-8873-4578-94d6-68d7a95de3ea --><\/p>\n<p>DENVER \u2013 Microbreweries across Colorado have some friends at the Capitol who showed them some love on Valentine\u2019s Day.<\/p>\n<p>Senate Bill 134 would separate the retail and wholesale portions of microbreweries, wineries and distillers for the purpose of liquor license infractions. Also, it would require  fines  leveled to be based on a percentage of revenue generated in the retail side only. The measure passed unanimously Tuesday in the Senate Business, Labor and Technology Committee.<\/p>\n<p>Examples of the infractions would be serving minors or overserving customers to the possible detriment of their health.<\/p>\n<p>\u201cCurrently, the way that our licensing division works is that brewers that also have a tasting room, or wineries that also have a tasting room, are unduly penalized for code violations,\u201d said <a href=\"http:\/\/leg.colorado.gov\/legislators\/leslie-herod\" target=\"_blank\" rel=\"noopener\">Rep. Leslie Herod, D-Denver<\/a>.<\/p>\n<p>Bill sponsor, <a href=\"http:\/\/leg.colorado.gov\/legislators\/jack-tate\" target=\"_blank\" rel=\"noopener\">Sen. Jack Tate, R-Centennial<\/a>, said growth and diversification of the alcohol-production industry necessitates adaptation of laws to ensure they are in line with industry realities.<\/p>\n<p>\u201cI think we should continue to encourage the investment in the entrepreneurial spirit that happens in this sector of the economy,\u201d Tate said.<\/p>\n<p>Ron Kammerzell, senior director of <a href=\"https:\/\/www.colorado.gov\/enforcement\" target=\"_blank\" rel=\"noopener\">Enforcement for the Colorado Department of Revenue<\/a>, saw the bill differently.<\/p>\n<p>\u201cWe believe this bill sends the message that overselling and service to minors, which are two of the most serious public safety violations in the liquor code, are less important when they happen in the sales room,\u201d Kammerzell said.<\/p>\n<p>Herod said she understands the concern, but she doesn\u2019t believe the bill would allow the industry to go unregulated.<\/p>\n<p>If a brewery did violate liquor laws, it would still face sanctions and fines from the state under SB 134, she said.<\/p>\n<p>Tommy Bibliowicz, owner and brewmaster at <a href=\"https:\/\/www.beeradvocate.com\/beer\/profile\/35764\/\" target=\"_blank\" rel=\"noopener\">4 Noses Brewing Co.<\/a> in Broomfield, said current law could disproportionately affect him for liquor law violations compared with other establishments if it suspended the wholesale license.<\/p>\n<p>\u201cWe\u2019d lose a certain degree of our regular production, which would result in additional termination of employees who had nothing to do with the violation,\u201d he said.<\/p>\n<p>Brian McEachron, co-founder of Steamworks Brewing Co., said any shutdown of production would have a substantial impact on microbreweries.<\/p>\n<p>McEachron said in an email that the legislation \u201cmakes some sense as a tap room and wholesale revenues are separate money streams that occur and are billed independently.\u201d<\/p>\n<p>He added: \u201cRules governing those sales are also different, so it seems that the fines for a violation of either should act as a remedy in relation to an event.\u201d<\/p>\n<p>For Herod, the bill is an acknowledgment of brewing, distilling and winemaking as Colorado industries worthy of protection by the General Assembly, Herod said.<\/p>\n<p>SB 134 was placed on the consent calendar, which is generally a fast track for getting legislation through the Senate.<\/p>\n<p><em class=\"mwc_shirttail\"><a href=\"mailto:lperkins@durangoherald.com\">lperkins@durangoherald.com<\/a><\/em><\/p>\n<p><em class=\"mwc_shirttail\">This article has been updated to correct the area that Rep.
