Plaintiffs sought up to $300,000 in compensatory damages and tens of thousands of dollars for medical bills.<\/p>\n<p>Gurule was admitted to Mercy on July 29, 2014, with severe and debilitating back spasms. He was in Mercy\u2019s care for 13 days before being transferred to two different hospitals in Colorado Springs.<\/p>\n<p>During his time at Mercy, Gurule developed a deep bedsore on his buttocks. The wound took more than a year to heal, and it continues to break open to this day, Gurule said.<\/p>\n<p>Nurses should have turned him over, documented his skin condition and made sure his protein levels remained sufficient, said his Denver lawyer, Robert Liechty.<\/p>\n<p>He said nurses caused the skin to sheer away when they dragged him across a mattress.<\/p>\n<p>Liechty said Monday he thought there was a 50-50 chance of winning the case.<\/p>\n<p>\u201cWe thought we had enough to show that the nursing staff really was not on top of his nutrition, but the jury said no, it wasn\u2019t enough,\u201d he said.<\/p>\n<p>Mercy\u2019s Denver defense lawyer Michelle Prud\u2019Homme said Gurule arrived at the hospital weighing nearly 600 pounds with a life-threatening back injury.<\/p>\n<p>Gurule\u2019s bed was elevated slightly, which isn\u2019t ideal for preventing bedsores, but it was necessary to make sure he received enough oxygen and stayed alive.<\/p>\n<p>During her opening statements, Prud\u2019Homme said Gurule wants to place all of the blame for his bedsore on the nursing staff, but in reality, a team of medical professionals are responsible for preventing bedsores.<\/p>\n<p>Gurule also didn\u2019t follow nursing orders as directed and removed his oxygen, which lead to complications, she said.<\/p>\n<p>In a statement released Monday, Mercy\u2019s Chief Medical Officer Bill Plauth touted the hospital\u2019s five-star rating for overall hospital quality from the Centers for Medicare and Medicaid Services, among other accolades.<\/p>\n<p>\u201cMercy is a mission-driven organization that is committed to treating all patients with compassionate, quality care,\u201d Plauth said in an email to the Herald. \u201c\u2026 These and other quality ratings place Mercy among the highest performing hospitals in the nation.\u201d<\/p>\n<p><em class=\"mwc_shirttail\"><a href=\"mailto:shane@durangoherald.com\">shane@durangoherald.com<\/a><\/em><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Hospital said it provided reasonable care<\/p>\n","protected":false},"author":1,"featured_media":70788,"comment_status":"open","ping_status":"open","sticky":false,"template":"","format":"standard","meta":{"_acf_changed":false,"footnotes":""},"categories":[],"tags":[488,68,1961],"naviga_topic":[],"class_list":["post-70787","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","tag-civil","tag-mercy-regional-medical-center","tag-private-health-care"],"acf":[],"author_name":"dh_admin","_links":{"self":[{"href":"https:\/\/dh.durangoherald.com\/tj\/wp-json\/wp\/v2\/posts\/70787","targetHints":{"allow":["GET"]}}],"collection":[{"href":"https:\/\/dh.durangoherald.com\/tj\/wp-json\/wp\/v2\/posts"}],"about":[{"href":"https:\/\/dh.durangoherald.com\/tj\/wp-json\/wp\/v2\/types\/post"}],"author":[{"embeddable":true,"href":"https:\/\/dh.durangoherald.com\/tj\/wp-json\/wp\/v2\/users\/1"}],"replies":[{"embeddable":true,"href":"https:\/\/dh.durangoherald.com\/tj\/wp-json\/wp\/v2\/comments?post=70787"}],"version-history":[{"count":0,"href":"https:\/\/dh.durangoherald.com\/tj\/wp-json\/wp\/v2\/posts\/70787\/revisions"}],"wp:featuredmedia":[{"embeddable":true,"href":"https:\/\/dh.durangoherald.com\/tj\/wp-json\/wp\/v2\/media\/70788"}],"wp:attachment":[{"href":"https:\/\/dh.durangoherald.com\/tj\/wp-json\/wp\/v2\/media?parent=70787"}],"wp:term":[{"taxonomy":"category","embeddable":true,"href":"https:\/\/dh.durangoherald.com\/tj\/wp-json\/wp\/v2\/categories?post=70787"},{"taxonomy":"post_tag","embeddable":true,"href":"https:\/\/dh.durangoherald.com\/tj\/wp-json\/wp\/v2\/tags?post=70787"},{"taxonomy":"naviga_topic","embeddable":true,"href":"https:\/\/dh.durangoherald.com\/tj\/wp-json\/wp\/v2\/naviga_topic?post=70787"}],"curies":[{"name":"wp","href":"https:\/\/api.w.org\/{rel}","templated":true}]}}
