{"id":66327,"date":"2020-01-24T15:21:24","date_gmt":"2020-01-24T22:21:24","guid":{"rendered":"https:\/\/dh.durangoherald.com\/tj\/durango-man-to-be-resentenced-for-2017-sexual-assault\/"},"modified":"2020-01-24T22:21:24","modified_gmt":"2020-01-24T22:21:24","slug":"durango-man-to-be-resentenced-for-2017-sexual-assault","status":"publish","type":"post","link":"https:\/\/dh.durangoherald.com\/tj\/durango-man-to-be-resentenced-for-2017-sexual-assault\/","title":{"rendered":"Durango man to be resentenced for 2017 sexual assault"},"content":{"rendered":"\n<p>A Durango man serving 10 years in prison for sexual assault involving a shotgun is renegotiating his plea agreement based on new evidence and a legal technicality that deemed his previous sentence illegal.<\/p>\n<p>Testimony presented at a co-defendant\u2019s trial and a Colorado Supreme Court decision last year forced prosecutors and defense attorneys to re-examine the case against James Zink, 20, who pleaded guilty in 2018 to second-degree assault, a Class 4 felony, and two counts of attempted sexual assault, a Class 5 felony.<\/p>\n<p>Zink\u2019s attorneys in May asked the court to release their client based on the new evidence presented at a trial in May that suggested his sexual contact with the alleged victim was consensual. District Court Judge William Herringer appointed the Colorado Public Defender\u2019s Office in Durango to the case, which in July sought Zink\u2019s release from prison.<\/p>\n<p>Prosecutors moved in November to renegotiate Zink\u2019s plea agreement after a Colorado Supreme Court decision in September that ruled <a href=\"https:\/\/law.justia.com\/cases\/colorado\/supreme-court\/2019\/17sc659.html\" target=\"_blank\" rel=\"noopener\">it illegal to sentence a defendant to both probation and prison<\/a>, further undermining the legal authority for Zink\u2019s incarceration.<\/p>\n<p><figure class=\"wp-block-image naviga-inline-image naviga-align-left alignleft\"><img decoding=\"async\" src=\"https:\/\/imengine.public.prod.dur.navigacloud.com\/?uuid=ed28c3e5-cbf2-4b34-820b-94ba188e1171&amp;function=cover&amp;type=preview&amp;source=false&amp;width=2000\" width=\"1000\" height=\"1333\" alt=\"Zink in 2020\" class=\"naviga-image\" loading=\"lazy\"><figcaption><span class=\"caption\">Zink in 2020<\/span><span class=\"credit\">du1-i-syn<\/span><\/figcaption><\/figure>\n<figure class=\"wp-block-image naviga-inline-image naviga-align-left alignleft\"><img decoding=\"async\" src=\"https:\/\/imengine.public.prod.dur.navigacloud.com\/?uuid=98345da0-fc57-4948-ae7c-ebb982863899&amp;function=cover&amp;type=preview&amp;source=false&amp;width=2000\" width=\"1000\" height=\"1333\" alt=\"Zink in 2017\" class=\"naviga-image\" loading=\"lazy\"><figcaption><span class=\"caption\">Zink in 2017<\/span><span class=\"credit\">du1-i-syn<\/span><\/figcaption><\/figure>\n<\/p><p>Zink appeared Friday in a La Plata County courtroom for the first time since Herringer sentenced him to 10 years in prison to be followed by 10 years of probation.<\/p>\n<p>\u201cThe Legislature intended to allow courts to chose one or the other,\u201d Supreme Court judges ruled in the case of Allman v. Colorado. \u201cProbation is an alternative to prison.\u201d<\/p>\n<p>Prosecutors accused Zink of sexually assaulting a Fort Lewis College student in October 2017 with co-defendants Devin Bond and Anthony Fitts. Fitts pleaded guilty to second-degree assault and two counts of attempted sexual assault. Bond went to trial on accusations of sexual assault causing submission by overbearing the victim\u2019s will, a Class 2 felony.<\/p>\n<p>But at Bond\u2019s trial, the alleged victim testified that at least some of the sexual acts on the night of the assault were consensual. Prosecutors moved to <a href=\"https:\/\/durangoherald.com\/articles\/277238\">dismiss charges against Fitts<\/a>, who at the time had spent eight months in prison.<\/p>\n<p>Judge Herringer declared a mistrial in Bond\u2019s case after he found a 12-person jury \u201chopelessly deadlocked\u201d as to the defendant\u2019s guilt. Bond spent 19 months in La Plata County Jail on $50,000 bail before <a href=\"https:\/\/durangoherald.com\/articles\/296212\">his case was eventually dismissed<\/a> after prosecutors discovered new evidence, which they declined to discuss.<\/p>\n<p>In light of the Colorado Supreme Court decision and the new evidence in the case, prosecutors moved to offer Zink a new plea deal and dropped the assault charge, said 6th Judicial District Attorney Christian Champagne.<\/p>\n<p>But Judge Herringer rejected the new plea agreement, in which Zink admitted to two counts of attempted sexual assault, which carry a possible sentence of one to three years in prison and a fine of $1,000 to $100,000.<\/p>\n<p>A copy of the proposed plea agreement was not publicly available Friday \u2013 Assistant District Attorney Sean Murray declined to discuss the case citing a gag order.
