{"id":64221,"date":"2019-05-24T12:06:00","date_gmt":"2019-05-24T18:06:00","guid":{"rendered":"https:\/\/dh.durangoherald.com\/tj\/conviction-overturned-in-gang-rape-case\/"},"modified":"2019-05-24T18:06:00","modified_gmt":"2019-05-24T18:06:00","slug":"conviction-overturned-in-gang-rape-case","status":"publish","type":"post","link":"https:\/\/dh.durangoherald.com\/tj\/conviction-overturned-in-gang-rape-case\/","title":{"rendered":"Conviction overturned in gang rape case"},"content":{"rendered":"\n<p><figure class=\"wp-block-image naviga-inline-image\"><img decoding=\"async\" src=\"https:\/\/imengine.public.prod.dur.navigacloud.com\/?uuid=6541b9b5-2b62-4544-9ff7-3383ba70f443&amp;function=cover&amp;type=preview&amp;source=false&amp;width=2000\" width=\"1200\" height=\"783\" alt=\"\" class=\"naviga-image\" loading=\"lazy\"><figcaption><span class=\"credit\">du1-i-syn<\/span><\/figcaption><\/figure>\n<\/p><p>A judge ordered the release of a Durango man from a six-year prison sentence this week after the alleged victim testified in the trial of a co-defendant that the sexual contact between her and the suspect was consensual.<\/p>\n<p>Sixth Judicial District Court Judge William Herringer ordered Tuesday that Anthony \u201cIzzy\u201d Fitts, 19, be released from prison, that his conviction be expunged from his record and that his case be dismissed with prejudice, meaning he cannot be tried again in court.<\/p>\n<p>Fitts was released from the La Plata County Jail, where he was being held to testify in <a href=\"https:\/\/durangoherald.com\/articles\/276897-trial-begins-for-durango-man-suspected-in-gang-rape\">a case against a co-defendant, Devin Bond<\/a>. During the first day of testimony in Bond\u2019s trial, the victim cleared Fitts of any wrongdoing in the assault.<\/p>\n<p>Deputy District Attorney Sean Murray called Fitts\u2019 conviction a \u201cmanifest injustice\u201d in an unopposed motion to nullify the court\u2019s decision to send him to prison for six years.<\/p>\n<p>Sixth Judicial District Attorney Christian Champagne said the victim had a \u201cfundamental misunderstanding\u201d of how the facts intersect with the law. She believed Fitts to be guilty, Champagne said, but prosecutors, upon learning the facts in testimony at trial, helped the victim understand that Fitts was \u201cfactually innocent.\u201d<\/p>\n<p>\u201cThe technical, legal elements of the crime, when applied to the facts of this case, show that he is, in fact, not guilty of a crime,\u201d Champagne said of Fitts. \u201cWe\u2019ll be examining the other co-defendant\u2019s case in light of this new evidence. We feel very clear about Mr. Fitts\u2019 situation.\u201d<\/p>\n<p><a href=\"https:\/\/durangoherald.com\/articles\/243361\">Herringer sentenced Fitts<\/a> at the end of September, acknowledging at the time that \u201che was more of a follower.\u201d Fitts expressed remorse at the sentencing hearing, apologized to the victim and suggested that he\u2019d grown and gotten closer with his family since the incident. About a dozen family members and friends cried throughout the sentencing hearing. He faced up to 16 years in prison.<\/p>\n<p>Fitts spent eight months in prison \u201cfor a crime he did not commit,\u201d according to Heather Little, his public defender. Fitts appeared Thursday at the La Plata County Courthouse in street clothes. He declined to comment.<\/p>\n<p>\u201cWe are grateful that an innocent man has been released from prison,\u201d Little said in an email Thursday to <em>The Durango Herald<\/em>. \u201cHe is focusing on spending time with his family and rebuilding his life. He does not wish to talk about his experience at this time.\u201d<\/p>\n<p>Fitts, Bond and James Zink, all of Durango, were accused by law enforcement of <a href=\"https:\/\/durangoherald.com\/articles\/190367-three-men-arrested-on-suspicion-of-sexual-assault\">sexually assaulting a woman at gunpoint<\/a> the evening of Oct. 14, 2017. Prosecutors said at Bond\u2019s trial that sex with the victim was consensual up until the point when a shotgun was racked. When the victim heard the sound, she began to fear for her life and felt she could not refuse the men\u2019s advances, prosecutors said.<\/p>\n<p>The men allegedly drove to three locations around Durango \u2013 the Wells Fargo bank on College Drive, the Conoco at the corner of Camino del Rio and Ninth Street, and the Durango Skate Park \u2013 while forcing the woman to perform oral sex.<\/p>\n<p>Zink was sentenced to <a href=\"https:\/\/durangoherald.com\/articles\/239250-man-sentenced-to-14-years-in-prison-for-sexual-assault\">14 years in prison and 10 years of probation<\/a> for second-degree assault and two counts of attempted sexual assault. Bond is facing a minimum of 16 years in prison if convicted by a jury of 12.
