{"id":63742,"date":"2018-11-26T16:58:24","date_gmt":"2018-11-26T23:58:24","guid":{"rendered":"https:\/\/dh.durangoherald.com\/tj\/school-district-acknowledges-police-call-after-previously-denying-incident\/"},"modified":"2018-11-26T23:58:24","modified_gmt":"2018-11-26T23:58:24","slug":"school-district-acknowledges-police-call-after-previously-denying-incident","status":"publish","type":"post","link":"https:\/\/dh.durangoherald.com\/tj\/school-district-acknowledges-police-call-after-previously-denying-incident\/","title":{"rendered":"School district acknowledges police call after previously denying incident"},"content":{"rendered":"\n<p><figure class=\"wp-block-image naviga-inline-image\"><img decoding=\"async\" src=\"https:\/\/imengine.public.prod.dur.navigacloud.com\/?uuid=5f6c7472-c66e-4cfa-9395-88490f5a31c5&amp;function=cover&amp;type=preview&amp;source=false&amp;width=2000\" width=\"2000\" height=\"1333\" alt=\"Letters from Superintendent Dan Snowberger and Needham Principal Jennifer McKenna acknowledge police were called on a district employee, contradicting previous statements.\" class=\"naviga-image\" loading=\"lazy\"><figcaption><span class=\"caption\">Letters from Superintendent Dan Snowberger and Needham Principal Jennifer McKenna acknowledge police were called on a district employee, contradicting previous statements.<\/span><span class=\"credit\">Durango Herald file<\/span><\/figcaption><\/figure>\n<\/p><p>Two Durango School District 9-R employees issued separate letters Sunday in response to an incident last month at Needham Elementary School where a district administrator had police called on her for reportedly trespassing.<\/p>\n<p>The letters by Superintendent Dan Snowberger and Needham Principal Jennifer McKenna came after <a href=\"https:\/\/durangoherald.com\/articles\/251338-durango-school-district-mum-on-why-employee-was-banned-from-needham-elementary-school\">The Durango Herald reported last week<\/a> about an incident on Oct. 19, in which McKenna directed her assistant to call 911 because the district\u2019s spokeswoman, Julie Popp, was not allowed at Needham and was trespassing.<\/p>\n<p>Snowberger and McKenna refused to discuss the incident when the <em class=\"Nimrod Ital\">Herald<\/em> asked each for comment, and even denied an incident took place at the elementary school.<\/p>\n<p>The <em class=\"Nimrod Ital\">Herald<\/em> provided Snowberger and McKenna with a call detail report from the Durango Police Department and an audio recording of the 911 call to police dispatch.<\/p>\n<p><figure class=\"wp-block-image naviga-inline-image naviga-align-left alignleft\"><img decoding=\"async\" src=\"https:\/\/imengine.public.prod.dur.navigacloud.com\/?uuid=1617a23a-b408-4afe-b317-cc1f847c3fd8&amp;function=cover&amp;type=preview&amp;source=false&amp;width=2000\" width=\"1167\" height=\"1800\" alt=\"Snowberger\" class=\"naviga-image\" loading=\"lazy\"><figcaption><span class=\"caption\">Snowberger<\/span><span class=\"credit\">du1-i-syn<\/span><\/figcaption><\/figure>\n<\/p><p>Snowberger denied that Popp was banned from Needham and disputed that the incident took place.<\/p>\n<p>In an email McKenna sent to the <em class=\"Nimrod Ital\">Herald<\/em> on Nov. 5, she wrote: \u201cI have no knowledge of such an incident at Needham.\u201d<\/p>\n<p>But in the letters sent Sunday by Snowberger to 9-R staff and McKenna to Needham parents, both acknowledge an incident took place, and both provided some details about what they say happened. But both letters also contradict the call detail report and the 911 dispatch recording.<\/p>\n<p>\u201cThere was a call placed to law enforcement from Needham on October 19,\u201d McKenna wrote Sunday in her letter to parents of Needham students. \u201cI requested the call because I believed an officer could better communicate with a parent than I could.\u201d<\/p>\n<p>McKenna goes on to explain that in certain circumstances, the school involves law enforcement to mediate situations with parents or students.<\/p>\n<p>\u201cIn more than a few of these conversations, heightened emotions have spurred me to stop a conversation and continue it a later time, sometimes with the help of a facilitator,\u201d she wrote.<\/p>\n<p>This is in contrast to why her assistant \u2013 who used her personal cellphone \u2013 said she was calling 911: That Popp was banned from the school\u2019s campus and Popp was aware of the ban. The police call log and 911 call recording did not include information about an escalated incident.<\/p>\n<p>McKenna did not respond to the <em class=\"Nimrod Ital\">Herald<\/em>\u2019s request for comment Monday.<\/p>\n<p><\/p><p>Snowberger first wrote in an email to the <em class=\"Nimrod Ital\">Herald<\/em> on Nov. 5 that he had \u201cno clue\u201d about the situation with Popp. On Nov. 15, Snowberger maintained that the situation \u201cis foreign to all you claim to be involved.\u201d<\/p>\n<p>\u201cDo you live in a world lined with conspiracy theories?\u201d Snowberger wrote. \u201c\u2026 Your attempt to slander an individual without evidence is sad and despicable. \u2026 I will not be threatened into providing false information about an incident to feed your desired story.<\/p>\n<p>\u201cThe facts are clear. There is no police incident report, which means that despite police being sent to Needham according to the call log you have provided, no incident had taken place.\u201d<\/p>\n<p>Snowberger, however, details the situation that took place at Needham in a letter he sent to 9-R staff on Sunday.<\/p>\n<p>\u201cIn our world of divisiveness, it is not uncommon for passions to create uncomfortable situations between parents and school staff,\u201d he wrote in the letter addressed to \u201cparents &amp; staff.\u201d<\/p>\n<p>\u201cSadly, sometimes those situations become challenging and we work to separate parties until cooler minds can prevail.\u201d<\/p>\n<p><\/p><p>Snowberger wrote that he withheld information about the incident, in part, because of the Federal Educational Rights and Privacy Act. The <em class=\"Nimrod Ital\">Herald<\/em>\u2019s attorney, Steven Zansberg, of Ballard Saphr LLP, said this is a misinterpretation of the act.<\/p>\n<p>\u201cFERPA is intended to protect students from having their \u2018educational records\u2019 \u2013 grades, tests, etc. \u2013 disclosed without their consent,\u201d Zansberg said Monday. \u201cIt does not apply to public records that discuss the conduct of school employees \u2026 discharging their official duties.<\/p>\n<p>\u201cEven if any students are named in such records, the School District is entitled, under FERPA, to redact those names and provide the public with information concerning the official conduct of public employees.\u201d<\/p>\n<p>Snowberger did not respond to the <em class=\"Nimrod Ital\">Herald<\/em>\u2019s request for comment Monday.<\/p>\n<p><figure class=\"wp-block-image naviga-inline-image naviga-align-left alignleft\"><img decoding=\"async\" src=\"https:\/\/imengine.public.prod.dur.navigacloud.com\/?uuid=2da67940-299d-40ce-b89f-f869fbde1c8c&amp;function=cover&amp;type=preview&amp;source=false&amp;width=2000\" width=\"400\" height=\"575\" alt=\"Stubbs\" class=\"naviga-image\" loading=\"lazy\"><figcaption><span class=\"caption\">Stubbs<\/span><span class=\"credit\">du1-i-syn<\/span><\/figcaption><\/figure>\n<\/p><p>Nancy Stubbs, president of the 9-R Board of Education, said the board is concerned about the district\u2019s handling of the situation and plans to meet with Snowberger on Tuesday.<\/p>\n<p>\u201cYou weren\u2019t given a coherent response,\u201d she said. \u201cAnd we\u2019re looking into how we can help you with that.\u201d<\/p>\n<p>David Ottman, a 9-R parent who is also a prosecutor for the 6th Judicial District in Durango, wrote a letter to Snowberger on Sunday saying it appears the school district was lying in its responses to the <em class=\"Nimrod Ital\">Herald<\/em> and did little to look into the situation with Popp.<\/p>\n<p>\u201cFrankly, whether your actions were deliberate or done out of ignorance is deeply troubling,\u201d Ottman wrote. \u201cAs a parent and taxpayer of the Durango School District, I am seriously concerned about your lack of professionalism, honesty and leadership in your written responses to the <em class=\"Nimrod Ital\">Durango Herald<\/em>.\u201d<\/p>\n<p>Ottman went on to say Snowberger\u2019s responses were troubling and lacked professionalism, especially since McKenna confirmed there was a situation with Popp in her letter to parents.<\/p>\n<p>\u201c(The <em class=\"Nimrod Ital\">Herald<\/em>\u2019s) questioning never merited such an unprofessional attack to the point at which you accuse them of being conspirators, and threated to cut them off from access to the District,\u201d he said.<\/p>\n<p>\u201cYour total lack of professionalism, candor and leadership in this matter gives me serious concerns about whether (my children) will be safe while at school.\u201d<\/p>\n<p>Ottman provided the <em class=\"Nimrod Ital\">Herald<\/em> with Snowberger\u2019s response to his letter, which Ottman called \u201cinadequate and unresponsive\u201d to his concerns.<\/p>\n<p>Snowberger wrote: \u201cIt is not uncommon for parents to become emotional and for tempers to rise when an issue with children arises. To ensure the safety of our campus, principals often request an officer to respond to ensure that parties are separated before situations become intense or create a negative environment for students, staff, and the public.\u201d<\/p>\n<p>Snowberger also included in the letter to Ottman details about the incident involving Popp that Snowberger previously told the Herald were protected by confidentiality laws. Snowberger wrote that the situation rose after an \u201cemotional conversation involving her children\u201d and she was then asked to leave.<\/p>\n<p>The police incident log and recorded call to dispatch, however, indicate Popp was previously banned from Needham and that she was aware she was not allowed on school grounds.<\/p>\n<p>Snowberger also wrote to Ottman that he was questioned by the <em class=\"Nimrod Ital\">Herald<\/em> only about police contact with a parent\/employee and a possible threat on campus.<\/p>\n<p>The <em class=\"Nimrod Ital\">Herald<\/em>, however, <a href=\"https:\/\/durangoherald.com\/articles\/251338-durango-school-district-mum-on-why-employee-was-banned-from-needham-elementary-school\">asked several questions<\/a> regarding the situation with Popp, including why Popp was reportedly banned and why police were called in the first place to Needham. Snowberger never answered these questions.<\/p>\n<p>The <em class=\"Nimrod Ital\">Herald<\/em> filed a Colorado Open Records Act request on Nov. 9 seeking records involving Popp\u2019s ban from Needham. The release of those records were denied by the district on Nov. 14.<\/p>\n<p>Zansberg wrote a letter challenging the district\u2019s denial.
