{"id":62065,"date":"2018-11-15T16:55:00","date_gmt":"2018-11-15T23:55:00","guid":{"rendered":"https:\/\/dh.durangoherald.com\/tj\/sheriffs-office-evicts-dozens-of-homeless-residents-west-of-durango\/"},"modified":"2018-11-15T23:55:00","modified_gmt":"2018-11-15T23:55:00","slug":"sheriffs-office-evicts-dozens-of-homeless-residents-west-of-durango","status":"publish","type":"post","link":"https:\/\/dh.durangoherald.com\/tj\/sheriffs-office-evicts-dozens-of-homeless-residents-west-of-durango\/","title":{"rendered":"Sheriff\u2019s Office evicts dozens of homeless residents west of Durango"},"content":{"rendered":"\n<p><!-- gallery:5c39037b-728b-4955-b5f2-0f4b200778e7 --><\/p>\n<p>About 40 homeless people camping west of Durango were told Wednesday by the La Plata County Sheriff\u2019s Office they have 48 hours to move.<\/p>\n<p>Deputies \u201ctagged\u201d camps and informed campers of the eviction on the eastern slopes of Hogsback, a popular hiking area and ridgeline just west of city limits. The Sheriff\u2019s Office plans to return to the slopes Friday to reassess the situation and try to assist as many people as possible, said spokesman Chris Burke.<\/p>\n<p>Exactly what will happen then is unclear, he said.<\/p>\n<p>The sweep was prompted by area residents who reported trash and nuisance foot traffic in the area, Burke said.<\/p>\n<p>\u201cSome of the homeowners are at wits\u2019 end,\u201d he said.<\/p>\n<p>Campsites speckled the eastern slope of Hogsback on Wednesday afternoon, many strewn with garbage. The La Plata County Sheriff\u2019s Office visited campsites Wednesday west of Durango city limits to notify homeless campers that they have 48 hours to vacate.<\/span><span class=\"credit\">Jerry McBride\/Durango Herald<\/span><\/figcaption><\/figure>\n<\/p><p>The city put a dumpster in the area for people to toss litter, but the only people who seemed to use it were sheriff\u2019s deputies when they did cleanup efforts, Burke said.<\/p>\n<p>The Sheriff\u2019s Office previously allowed camping west of city limits. <a href=\"https:\/\/durangoherald.com\/articles\/237159\">But the camp was closed<\/a> after the city of Durango announced it would open its own camp for homeless residents. But the city reneged on the offer, leaving homeless people without a place to camp.<\/p>\n<p>Sheriff Sean Smith said <a href=\"https:\/\/durangoherald.com\/articles\/246840-homeless-left-out-of-working-group-on-homelessness\">he is working with other agencies<\/a> to find somewhere else for people without homes to sleep.<\/p>\n<p>The 9th Judicial Circuit Court in Boise, Idaho, ruled earlier this year that making it illegal for someone to sleep on public property when they have nowhere else to go is a violation of the U.S. Constitution\u2019s Eighth Amendment, which prohibits cruel and unusual punishment.<\/p>\n<p><figure class=\"wp-block-image naviga-inline-image\"><img decoding=\"async\" src=\"https:\/\/imengine.public.prod.dur.navigacloud.com\/?uuid=bfacad17-12d9-46de-b0bf-f3afb18c40b5&amp;function=cover&amp;type=preview&amp;source=false&amp;width=2000\" alt=\"Tom Cowing with La Plata County Sheriff\u2019s Office talks with someone who was camping west of Durango city limits. The American Civil Liberties Union has also sent at least one pointed letter to the city urging the city to stop enforcing its camping ban.<\/p>\n<p><a href=\"https:\/\/durangoherald.com\/articles\/243059-durango-stops-enforcing-camping-ban-at-night\">The city issued a moratorium<\/a> in October saying it would not enforce its camping ban between the hours of sunset and sunrise on public open space, excluding sidewalks and parks. Smith said the moratorium gives people a place to sleep, therefore, meeting the legal threshold required by the 9th Circuit Court decision.<\/p>\n<p>But Mark Silverstein, legal director with the ACLU, said Wednesday\u2019s eviction is the latest example of local officials bouncing homeless people around, something that has been happening for months.
