{"id":53035,"date":"2020-06-23T18:32:31","date_gmt":"2020-06-24T00:32:31","guid":{"rendered":"https:\/\/dh.durangoherald.com\/tj\/trial-delayed-again-for-father-suspected-of-killing-dylan-redwine\/"},"modified":"2020-06-24T00:32:31","modified_gmt":"2020-06-24T00:32:31","slug":"trial-delayed-again-for-father-suspected-of-killing-dylan-redwine","status":"publish","type":"post","link":"https:\/\/dh.durangoherald.com\/tj\/trial-delayed-again-for-father-suspected-of-killing-dylan-redwine\/","title":{"rendered":"Trial delayed again for father suspected of killing Dylan Redwine"},"content":{"rendered":"\n<p><figure class=\"wp-block-image naviga-inline-image\"><img decoding=\"async\" src=\"https:\/\/imengine.public.prod.dur.navigacloud.com\/?uuid=c59d180a-ac54-494d-98d9-767017440354&amp;function=cover&amp;type=preview&amp;source=false&amp;width=2000\" width=\"1600\" height=\"1067\" alt=\"Mark Redwine\u2019s trial has been reset to late October after a ban on jury trials made a July date untenable.\" class=\"naviga-image\" loading=\"lazy\"><figcaption><span class=\"caption\">Mark Redwine\u2019s trial has been reset to late October after a ban on jury trials made a July date untenable.<\/span><span class=\"credit\">Durango Herald file<\/span><\/figcaption><\/figure>\n<\/p><p>Once again, the trial has been delayed for Mark Redwine, who was arrested nearly three years ago for allegedly killing his 13-year-old son.<\/p>\n<p>Redwine was scheduled to start a 28-day trial July 8.<\/p>\n<p>The Colorado Supreme Court this month, however, extended a ban on jury trials until Aug. 3 because of the novel coronavirus outbreak, necessitating another push back in Redwine\u2019s long-awaited trial.<\/p>\n<p>After a brief discussion Tuesday between prosecutors, Redwine\u2019s defense attorneys and Judge Jeffery Wilson, who is overseeing the case, a new trial was scheduled to begin Oct. 28.<\/p>\n<p>Wilson said under current conditions, \u201cit would be impossible to safely assemble a jury pool due to the public health crisis\u201d for Redwine\u2019s trial, which is expected to bring in an estimated 600 people to the high-profile case.<\/p>\n<p>\u201cThere\u2019s really no good time (to reset the trial) when we don\u2019t know what\u2019s going to happen,\u201d Wilson said. \u201cBut my personal opinion is the longer we wait, the less likely it\u2019ll go if we see a resurgence of the virus (in the fall).\u201d<\/p>\n<p>Wilson said there is only one courtroom in the La Plata Courthouse that can accommodate such a large jury pool while at the same time adhering to social-distancing guidelines.<\/p>\n<p>He said the earliest availability for the courtroom was Aug. 31, and initially suggested starting the trial on that date.<\/p>\n<p>But 6th Judicial District Attorney Christian Champagne, prosecuting the case, said his office has \u201cmajor scheduling\u201d issues over the next few months, and wouldn\u2019t be able to start Redwine\u2019s trial until early November.<\/p>\n<p>Justin Bogan, one of Redwine\u2019s public defenders, said he would be ready Aug. 31.<\/p>\n<p>But Champagne said if a trial were set for August, his office would have to replace a special deputy district attorney assisting with the case, which would result in further delays.<\/p>\n<p>\u201cIt would take a substantial amount of time for a new member of the team to catch up,\u201d Champagne said.<\/p>\n<p>All sides agreed to an Oct. 28 start date. A pre-trial conference hearing is scheduled for Oct. 8.<\/p>\n<p><a href=\"https:\/\/durangoherald.com\/articles\/324575\">This is the third time Redwine\u2019s trial has been delayed<\/a> as a result of complications associated with the coronavirus outbreak. The trial has also undergone several other postponements since his arrest in 2017.<\/p>\n<p>\u201cWe\u2019ve delayed this and delayed this and delayed this, mostly to make sure Mr. Redwine has a fair trial,\u201d Wilson said. \u201cAnd then other things happened.\u201d<\/p>\n<p>Redwine was arrested July 22, 2017, on suspicion of killing his 13-year-old son, Dylan, who disappeared from his father\u2019s home in Vallecito in November 2012. Dylan\u2019s remains were found in June 2013, 10 miles from his father\u2019s home.<\/p>\n<p>Speaking via teleconference, Elaine Hall, Dylan\u2019s mother, voiced frustration with the setbacks that have plagued Redwine\u2019s case.<\/p>\n<p>\u201cI understand what\u2019s going on with the pandemic,\u201d she said. \u201cBut \u2026 it\u2019s very frustrating. And there\u2019s nothing we can say or do about it.\u201d<\/p>\n<p>Champagne said in a previous interview with <em>The Durango Herald<\/em> that the trial initially experienced several delays because Redwine\u2019s defense attorneys asked for a number of postponements to prepare for trial.<\/p>\n<p>Redwine was supposed to go to trial in September 2019, but then one of his public defenders, John Moran, was arrested on suspicion of domestic violence. <a href=\"https:\/\/durangoherald.com\/articles\/310483\">The charges were ultimately dismissed<\/a>, but court proceedings were further delayed.<\/p>\n<p>The delays have resulted in the now 58-year-old Vallecito man spending nearly three years in La Plata County Jail.
