Shupe said Devilbiss shouted, \u201cThis is America\u201d and told people in the group to \u201cgo home.\u201d<\/p>\n
A female in the group started singing, and \u201cthat infuriated him,\u201d Shupe said. Devilbiss came around the outside patio area, got in her face and ripped a mask off the woman\u2019s face, police said.<\/p>\n
Another woman tried to break up the fight and Devilbiss allegedly threw her to the ground. Calls reporting the incident started to come into Durango police around 6:30 p.m., Shupe said.<\/p>\n
Initially, officers were just going to write Devilbiss a ticket.<\/p>\n
\u201cBut he continued to be belligerent and we took him into custody,\u201d Shupe said. \u201cHe was intoxicated and didn\u2019t want to mellow out.\u201d<\/p>\n
Devilbiss was being held on suspicion of disorderly conduct and disturbing the peace. He was taken to the La Plata County Jail on a $499 bond.<\/p>\n
Shupe said Devilbiss was not arrested on an assault charge because there were no reported injuries to anyone involved.<\/p>\n
\u201cDisorderly conduct is still unwanted touching or grabbing,\u201d he said. \u201cHe definitely was confrontational with them, and it spiraled into disorderly conduct.\u201d<\/p>\n
Shupe said Devilbiss was not charged with any hate or bias-related crimes.<\/p>\n
\u201cNo one on scene said he spouted any kind of slurs that would indicate bias,\u201d Shupe said. \u201cI think it was more he was irritated because his dinner was interrupted.\u201d<\/p>\n
