{"id":51567,"date":"2020-09-15T19:03:36","date_gmt":"2020-09-16T01:03:36","guid":{"rendered":"https:\/\/dh.durangoherald.com\/tj\/review-of-officer-involved-shooting-nears-completion-in-durango\/"},"modified":"2020-09-16T01:03:36","modified_gmt":"2020-09-16T01:03:36","slug":"review-of-officer-involved-shooting-nears-completion-in-durango","status":"publish","type":"post","link":"https:\/\/dh.durangoherald.com\/tj\/review-of-officer-involved-shooting-nears-completion-in-durango\/","title":{"rendered":"Review of officer-involved shooting nears completion in Durango"},"content":{"rendered":"\n<p><figure class=\"wp-block-image naviga-inline-image\"><img decoding=\"async\" src=\"https:\/\/imengine.public.prod.dur.navigacloud.com\/?uuid=de4a95d9-3f74-43c7-a49b-23ee11e6700a&amp;function=cover&amp;type=preview&amp;source=false&amp;width=2000\" width=\"1600\" height=\"1067\" alt=\"A final review of an officer-involved shooting at O\u2019Reilly Auto Parts in Durango is about two to three weeks away.\" class=\"naviga-image\" loading=\"lazy\"><figcaption><span class=\"caption\">A final review of an officer-involved shooting at O\u2019Reilly Auto Parts in Durango is about two to three weeks away.<\/span><span class=\"credit\">Jerry McBride\/Durango Herald file<\/span><\/figcaption><\/figure>\n<\/p><p>A 6th Judicial District Attorney\u2019s Office review of a Durango police officer-involved shooting is about two to three weeks from completion, putting off any potential release of body-cam footage until that time.<\/p>\n<p>According to the Durango Police Department, officers were dispatched to O\u2019Reilly Auto Parts at 2475 Main Ave. around 4:30 a.m. July 1 <a href=\"https:\/\/durangoherald.com\/articles\/330577\">after being alerted by a business alarm of a break-in<\/a>.<\/p>\n<p>As authorities surrounded the building, the suspect, identified as Jason Noble Snow, 34, of Pagosa Springs was told to put down a gun he was carrying, but instead he fired at an officer, said Durango Police Chief Bob Brammer.<\/p>\n<p>The officer, Padraic Ingle, fired back, killing Snow, who was pronounced dead at the scene before medical personnel arrived.<\/p>\n<p><figure class=\"wp-block-image naviga-inline-image naviga-align-left alignleft\"><img decoding=\"async\" src=\"https:\/\/imengine.public.prod.dur.navigacloud.com\/?uuid=b90504f4-8de6-44d3-b14d-60f123627d28&amp;function=cover&amp;type=preview&amp;source=false&amp;width=2000\" width=\"998\" height=\"1338\" alt=\"Snow\" class=\"naviga-image\" loading=\"lazy\"><figcaption><span class=\"caption\">Snow<\/span><span class=\"credit\">du1-i-syn<\/span><\/figcaption><\/figure>\n<\/p><p>The investigation into the Durango Police Department\u2019s first officer-involved shooting since 2000 was looked into by the Colorado Bureau of Investigation.<\/p>\n<p>CBI spokeswoman Susan Medina said the investigation was presented to the  6th Judicial District Attorney\u2019s Office earlier in the month for review. The 6th Judicial District Attorney\u2019s Office is now conducting its own separate investigation and review.<\/p>\n<p>District Attorney Christian Champagne said Tuesday his office is about two to three weeks from completing its review. He declined to comment further until a full letter with his findings is done.<\/p>\n<p>Brammer said police body-cam footage of the incident cannot be made public until the District Attorney\u2019s Office findings are finished. Once the review is complete, Brammer said the department will assess the best way to make the video public.<\/p>\n<p>Brammer said it is unlikely DPD will put the video out \u201ccarte blanche\u201d because of the violent nature of the incident and the fact both the officer\u2019s and suspect\u2019s family and friends live in the community.<\/p>\n<p>\u201cIt is a violent, grotesque encounter where someone dies, and that\u2019s not to be taken lightly,\u201d Brammer said. \u201cWhat I fear is, if we release this video just carte blanche \u2026 then we\u2019re going to create a lot of community harm.\u201d<\/p>\n<p>Instead, in order to maintain transparency, Brammer said a more preferred option would be for people who are interested in seeing the video to set up an appointment at the Durango police station to view it.<\/p>\n<p>\u201cI think that\u2019s the best scenario,\u201d Brammer said.<\/p>\n<p><em>The Durango Herald<\/em> filed an open records request for the body-cam footage but was denied, with Durango police citing an open investigation.<\/p>\n<p><a href=\"https:\/\/durangoherald.com\/articles\/328770\">A new state law speeds up the time<\/a> in which Colorado police departments must release footage for officer-involved shootings, but that does not take effect until 2023.<\/p>\n<p>Jeff Roberts, executive director of the Colorado Freedom of Information Coalition, said previously that under current laws the disclosure of footage is a criminal justice record subject to the Colorado Criminal Justice Records Act.<\/p>\n<p>\u201cRecords custodians can withhold such records, or release only portions, if they determine that disclosure would be \u2018contrary to the public interest,\u2019\u201d he said. \u201cIn making that determination, they are supposed to conduct a balancing test of factors that includes the public interest served by disclosure, any privacy interests and the agency\u2019s interest in conducting its investigation.\u201d<\/p>\n<p>Brammer maintains the facts of the incident are \u201ccut and dry.\u201d<\/p>\n<p>\u201cIt\u2019s clearly a self-defense situation,\u201d he said.<\/p>\n<p>After officers arrived at O\u2019Reilly Auto Parts and set up a perimeter, Brammer said authorities spotted a white man in his 30s, later identified as Snow, in the back of the store trying to escape.<\/p>\n<p>Snow then allegedly ran to the front of the store, where he encountered another officer. Police say that officer identified himself as law enforcement and Snow fired gunshots through the business\u2019 glass door.<\/p>\n<p>No officers were injured in the incident. Ingle has since returned to duty, Brammer said.<\/p>\n<p><figure class=\"wp-block-image naviga-inline-image\"><img decoding=\"async\" src=\"https:\/\/imengine.public.prod.dur.navigacloud.com\/?uuid=09caffaf-ee2e-4a79-b1f3-ddb713de46fa&amp;function=cover&amp;type=preview&amp;source=false&amp;width=2000\" width=\"467\" height=\"456\" alt=\"Hiehle\" class=\"naviga-image\" loading=\"lazy\"><figcaption><span class=\"caption\">Hiehle<\/span><span class=\"credit\">du1-i-syn<\/span><\/figcaption><\/figure>\n<\/p><p>A woman who is suspected of aiding the burglary <a href=\"https:\/\/durangoherald.com\/articles\/330998-woman-arrested-in-connection-with-burglary-officerinvolved-shooting\">as the lookout and planned getaway driver<\/a>, Paige Hiehle, 23, of Durango fled the scene but was located about a week later and arrested.<\/p>\n<p>Hiehle pleaded guilty Sept. 4 to conspiracy to commit second-degree burglary of a building.
