{"id":51456,"date":"2020-09-22T00:40:17","date_gmt":"2020-09-22T06:40:17","guid":{"rendered":"https:\/\/dh.durangoherald.com\/tj\/ginsburgs-death-could-reshape-colorados-hotly-contested-senate-race\/"},"modified":"2026-03-31T03:56:18","modified_gmt":"2026-03-31T09:56:18","slug":"ginsburgs-death-could-reshape-colorados-hotly-contested-senate-race","status":"publish","type":"post","link":"https:\/\/dh.durangoherald.com\/tj\/ginsburgs-death-could-reshape-colorados-hotly-contested-senate-race\/","title":{"rendered":"Ginsburg\u2019s death could reshape Colorado\u2019s hotly contested Senate race"},"content":{"rendered":"\n<p><!-- gallery:79019e36-a18e-4404-b031-ee5e1ca41e0d --><\/p>\n<p>With 45 days until the 2020 election, Ruth Bader Ginsburg\u2019s death promises to add more intensity to Colorado\u2019s hotly contested U.S. Senate race and will likely force both campaigns to change strategy in the final stretch.<\/p>\n<p>Within hours of the U.S. Supreme Court justice\u2019s passing Friday at age 87, Democratic calls for Republican incumbent Cory Gardner to hold off on voting for a replacement until after the Nov. 3 contest started growing to a fever pitch.<\/p>\n<p>\u201cThe Senate must not confirm a new Supreme Court Justice until after a new president is sworn in next year,\u201d former Colorado Gov. John Hickenlooper, Gardner\u2019s Democratic challenger, said in a written statement late Friday. \u201cSen. Gardner must uphold the commitment he set more than four years ago and allow the president elected in November to make this decision.\u201d<\/p>\n<p>The focus on the Supreme Court could make it more difficult for Gardner to continue working to sell his accomplishments to Coloradans and tear down Hickenlooper as he looks to close a significant deficit in his polling and approval numbers.<\/p>\n<p>\u201cIt\u2019s already hard for him to get that message through in a media environment that\u2019s so focused on the pandemic and the economy and civil unrest,\u201d said Seth Masket, a University of Denver political science professor. \u201cThis is just one more thing making it harder for him to focus voters on favorable ground for him.\u201d<\/p>\n<p>Gardner on Friday released a statement on Ginsburg\u2019s death, calling her a \u201ctrailblazing leader.\u201d But he didn\u2019t address how he thinks Senate Republicans should handle replacing her. His spokespeople, both in his Senate office and for his reelection campaign, did not return multiple messages from The Colorado Sun seeking comment.<\/p>\n<p>Then on Saturday afternoon, while speaking at Club 20 in Grand Junction, he declined to say whether he could vote to confirm a new justice before the November election. Now is a time to mourn, he said. \u201cThere is time for debate. There is time for politics,\u201d he said. \u201cBut the time, for now, is to pray for the (Ginsburg) family and to make sure that we keep their family in our hearts and prayers as we mourn as a nation.\u201d<\/p>\n<p>Gardner was among the Senate Republicans in 2016 who successfully pushed to hold off on picking a replacement for conservative Justice Antonin Scalia after he died in February 2016, nine months before that year\u2019s presidential contest. As a result, President Barack Obama\u2019s nomination of jurist Merrick Garland to replace Scalia never moved forward.<\/p>\n<p>Instead, Coloradan Neil Gorsuch was tapped by Trump to fill the vacancy on Jan. 31, 2017, just 11 days after the new president was sworn into office.<\/p>\n<p>\u201cI think we\u2019re too close to the election,\u201d Gardner said in arguing that the Senate hold off on replacing Scalia in 2016. \u201cThe president who is elected in November should be the one who makes this decision.\u201d<\/p>\n<p>Gardner, who has already become a source of national focus over how he may handle the situation given he\u2019s in a difficult reelection bid, typically waits until the 11th hour to disclose his thinking on tough votes.<\/p>\n<p>That\u2019s how he handled the nomination of Justice Brett Kavanaugh, who faced sexual assault allegations, and Trump\u2019s impeachment trial earlier this year, as well the president\u2019s use of national emergency powers to fund the construction of a border wall in 2019.<\/p>\n<p><strong>Read more at The Colorado Sun<\/strong><\/p>\n<p><em class=\"mwc_shirttail\"><a href=\"https:\/\/coloradosun.com\/\" target=\"_blank\" rel=\"noopener\">The Colorado Sun is a reader-supported, journalist-owned news outlet exploring issues of statewide interest.
