{"id":50988,"date":"2020-10-15T13:12:45","date_gmt":"2020-10-15T19:12:45","guid":{"rendered":"https:\/\/dh.durangoherald.com\/tj\/judge-wont-force-new-mexico-to-send-children-back-to-school\/"},"modified":"2020-10-15T19:12:45","modified_gmt":"2020-10-15T19:12:45","slug":"judge-wont-force-new-mexico-to-send-children-back-to-school","status":"publish","type":"post","link":"https:\/\/dh.durangoherald.com\/tj\/judge-wont-force-new-mexico-to-send-children-back-to-school\/","title":{"rendered":"Judge won\u2019t force New Mexico to send children back to school"},"content":{"rendered":"\n<p>In a 167-page decision, U.S. District Judge James Browning wrote that plaintiffs likely can\u2019t sue the governor and that the regulations ordered by the state are likely to be upheld.<\/p>\n<p>On Sept. 8, the state gave most school districts the option to reopen, as long as they were located in counties with low rates of COVID-19 infections.<\/p>\n<p>Parents in counties forced to remain closed were livid, including the mother of a 13-year-old girl with special needs in Hobbs.<\/p>\n<p>Browning did grant one narrow injunction on her behalf, ordering Public Education Department Secretary Ryan Stewart to tell her school to rethink her online-only learning plan. Her mother, Shannon Woodworth, joined the lawsuit alleging a violation of the Individuals with Disabilities Education Act.<\/p>\n<p>\u201cIn spite of the ongoing pandemic, Secretary Stewart must provide Woodworth\u2019s daughter with a \u2018free and appropriate public education\u2019 as the IDEA requires,\u201d Browning wrote in the order. \u201cThis might include in-person instruction provided in small groups, with appropriate precautions including social distancing.\u201d<\/p>\n<p>Browning\u2019s order was only for that student, and he wrote that it was unlikely that her lawsuit could spearhead a class-action lawsuit on behalf of other students with special needs.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>a 167-page decision, U.S. District Judge James Browning wrote that plaintiffs likely can\u2019t sue the governor and that the regulations ordered by the state are likely to be upheld.
