{"id":50575,"date":"2020-11-02T19:00:10","date_gmt":"2020-11-03T02:00:10","guid":{"rendered":"https:\/\/dh.durangoherald.com\/tj\/mexican-national-arrested-in-durango-sentenced-to-probation\/"},"modified":"2020-11-03T02:00:10","modified_gmt":"2020-11-03T02:00:10","slug":"mexican-national-arrested-in-durango-sentenced-to-probation","status":"publish","type":"post","link":"https:\/\/dh.durangoherald.com\/tj\/mexican-national-arrested-in-durango-sentenced-to-probation\/","title":{"rendered":"Mexican national arrested in Durango sentenced to probation"},"content":{"rendered":"\n<p><figure class=\"wp-block-image naviga-inline-image naviga-align-left alignleft\"><img decoding=\"async\" src=\"https:\/\/imengine.public.prod.dur.navigacloud.com\/?uuid=2f243076-a252-42e0-887c-81c02b2a0f60&amp;function=cover&amp;type=preview&amp;source=false&amp;width=2000\" width=\"1000\" height=\"1333\" alt=\"Miranda-Cabrera\" class=\"naviga-image\" loading=\"lazy\"><figcaption><span class=\"caption\">Miranda-Cabrera<\/span><span class=\"credit\">du1-i-syn<\/span><\/figcaption><\/figure>\n<\/p><p>A Mexican citizen who was detained in Durango by Immigration and Customs Enforcement earlier this year received 12 months\u2019 probation after pleading guilty to a criminal mischief charge that involved domestic violence.<\/p>\n<p>David Miranda-Cabrera, then 37, <a href=\"https:\/\/durangoherald.com\/articles\/337562\">was arrested March 27 after the Durango Police Department was called to his girlfriend\u2019s apartment for a disturbance<\/a>.<\/p>\n<p>Initially, Miranda-Cabrera\u2019s girlfriend told investigators Miranda-Cabrera grabbed a knife and tried to stab her. He was arrested on suspicion of attempted murder and domestic violence, among other charges.<\/p>\n<p>But after further investigation, the 6th Judicial District Attorney\u2019s Office in July reduced the charges against Miranda-Cabrera.<\/p>\n<p>Miranda-Cabrera pleaded guilty July 21 to criminal mischief, with an underlying factual basis of domestic violence, a misdemeanor.<\/p>\n<p>At a sentencing hearing Monday, David Greenberg, Miranda-Cabrera\u2019s Durango attorney, said Miranda-Cabrera\u2019s girlfriend misstated that Miranda-Cabrera was holding the knife.<\/p>\n<p>Miranda-Cabrera\u2019s girlfriend later told investigators it was she who was holding the knife, Greenberg said, and he did not hit her.<\/p>\n<p>Instead, Greenberg said Miranda-Cabrera locked his girlfriend out of the apartment, forcing her to break a window to get in, which was the basis for the criminal mischief charge.<\/p>\n<p>Miranda-Cabrera was sentenced to one year of probation. He must not violate the law or a protection order in place. He also is prohibited from using drugs and alcohol, and will have to comply with treatment after a domestic violence evaluation.<\/p>\n<p>If Miranda-Cabrera breaks the terms of his probation, he faces 10 days in jail.<\/p>\n<p>Alethea Smock, spokeswoman for ICE in Denver, said Miranda-Cabrera is not in ICE custody and is going through immigration proceedings.<\/p>\n<p>ICE issued a detainer for Miranda-Cabrera on March 30, but the detainer was not honored, based on a state law that bars local law enforcement from assisting ICE in immigration cases, and he was released from local custody.<\/p>\n<p>\u201cThe state passed a law last year that effectively shuts down cooperation between ICE and local law enforcement agencies, meaning local (law enforcement agents) are not allowed to honor our detainers.
