Jared Polis remove the director of the state Air Pollution Control Division, who is called out in a whistleblower complaint alleging the state endangers public health by unlawfully approving permits to pollute the air.<\/p>\n<p>The coalition also asked the state attorney general\u2019s office to launch its own investigation into allegations the state has speeded permits \u201cat all costs\u201d and may have falsified data in the process.<\/p>\n<p>The staff whistleblowers\u2019 detailed complaint to the Environmental Protection Agency Office of the Inspector General is just the latest evidence that the state Department of Public Health and Environment and its Air Pollution Control Division flout the law, allowing industry to ruin Colorado\u2019s air and harm public health, the groups said.<\/p>\n<p>\u201cThis is our Flint, Michigan,\u201d said Ean Tafoya, co-chair of the Colorado Latino Forum, who was joined at a news conference by WildEarth Guardians, 350 Colorado and a handful of other activist organizations.<\/p>\n<p>\u201cStop putting polluters over people,\u201d 350 Colorado director Micah Parkin said.<\/p>\n<p>The groups called for the removal of APCD Director Garry Kaufman, who has declined through department information officers to comment on the complaint.<\/p>\n<p>\u201cIt\u2019s important to note that Colorado is not in violation of any state or federal law or regulation with regard to modeling,\u201d a spokesperson said in an email Thursday afternoon. \u201cWe cannot comment on the specific allegations at this time, but we are committed to collecting all of the facts related to the allegations and resolving this matter.\u201d<\/p>\n<p>In addition to a state investigation of \u201cofficial misconduct\u201d alleged in the complaint to the EPA, Colorado should review and revoke any polluting permits approved since 2012 where laws weren\u2019t followed, said Jeremy Nichols, a program director for WildEarth Guardians.<\/p>\n<p>\u201cThis is a huge, huge deal,\u201d Nichols said of the complaint. \u201cWe cannot overstate the severity of this news and what it means to our health and well-being,\u201d he added, noting metro Denver\u2019s continuing slide into deeper categories of EPA ozone violations. \u201cWithout a doubt, illegal air pollution permitting is contributing to these problems and putting people at risk.\u201d<\/p>\n<p>The groups also connected the whistleblowers\u2019 allegations of easy and perhaps illegal permitting to other ongoing debates over regulation pollution in Colorado. They want tougher state action, for example, against air and ground pollution from the Suncor refinery, and want to boost real-time pollution monitoring and enforcement by state health.<\/p>\n<p>The state\u2019s leniency on oil and gas permitting, Suncor, other polluters on the Front Range, and the placement of polluting industry and building projects in low-income neighborhoods all are part of a long trend, the coalition said.<\/p>\n<p>\u201cThere is a pattern and practice of putting the polluters\u2019 interests first,\u201d Nichols said.<\/p>\n<p>The response from environmental groups follows reporting by The Colorado Sun that state air pollution control managers endangered the health of Coloradans by unlawfully approving permits for industry without federally-mandated modeling or monitoring. The three state health employees most responsible for computer modeling of potential air pollution in the permitting process filed the complaint with the EPA.<\/p>\n<p>The APCD employees claim their leaders ordered them in mid-March this year to stop performing modeling required by the federal Clean Air Act. The complaint, filed on behalf of the employees by a Maryland nonprofit legal group specializing in whistleblower actions, says managers bypassed modeling rules in order to speed permits and avoid a paper trail should the state be sued by environmental groups.<\/p>\n<p>The EPA\u2019s inspector general acknowledged receiving the complaint, but said it would not comment to the media. The inspector general said its options include beginning an in-house investigation, dismissing the complaint, or referring it to another agency, such as the FBI.<\/p>\n<p>Polis\u2019 office and Attorney General Phil Weiser\u2019s office did not respond immediately to requests for comment Thursday.<\/p>\n<p>Parkin, of 350 Colorado, said Denver residents had to breathe air reported as dangerous to their health for \u201cmore than 260 days in 2018 and 2019. \u2026 The decisions made by these leaders are truly life and death for Coloradans.\u201d<\/p>\n<p><em class=\"mwc_headline2-18\">Read more at The Colorado Sun<\/em><\/p>\n<p><em class=\"mwc_shirttail\"><a href=\"https:\/\/coloradosun.com\/\" target=\"_blank\" rel=\"noopener\">The Colorado Sun is a reader-supported, nonpartisan news organization dedicated to covering Colorado issues.
