Non-substantive emails may include scheduling and availability discussions between council and board members, forwarding information and responding to a constituent, and posing a question for future discussion.<\/p>\n<p>\u201cThe Open Meetings Law previous to this would have barred communications between more than two members of a body, and this is really a nod to efficiency and the fact that you\u2019re not really discussing the merits of a topic,\u201d city attorney Dirk Nelson said<\/p>\n<p>The city\u2019s Parks and Recreation Advisory Board invited Nelson to its most recent meeting to ask for clarification about the changes.<\/p>\n<p>In April, House Bill 21-1025 clarified the text of the Open Meetings Law about electronic mail to use the word \u201cexchange\u201d instead of \u201cuse.\u201d So the law now reads: \u201cIf elected officials exchange electronic mail to discuss pending legislation or other public business among themselves, the electronic mail is subject to the requirements of this section.\u201d<\/p>\n<p>\u201cThis is something that the municipalities in the (Colorado) Municipal League have been after for a while, to clarify that we\u2019re not inadvertently creating issues by having those non-substantive discussions in the Legislature,\u201d Nelson said.<\/p>\n<p>Ultimately, these changes create a convenience for council and board members.<\/p>\n<p>\u201cIt\u2019s a convenience that most private businesses take for granted, being able to send out and say, \u2018Hey, is everybody available for a meeting this week,\u2019 when that kind of thing would have been particularly problematic under the Open Meetings Law,\u201d Nelson said.<\/p>\n<p><em id=\"emphasis-865736393571c3afdf8ccbd33e286f47\"><a href=\"mailto:njohnson@durangoherald.com\">njohnson@durangoherald.com<\/a><\/em><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Non-substantive communications no longer subject to Open Meetings Law<\/p>\n","protected":false},"author":1,"featured_media":45022,"comment_status":"open","ping_status":"open","sticky":false,"template":"","format":"standard","meta":{"_acf_changed":false,"footnotes":""},"categories":[],"tags":[28,869],"naviga_topic":[],"class_list":["post-45021","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","tag-headlines","tag-public-officials"],"acf":[],"author_name":"dh_admin","_links":{"self":[{"href":"https:\/\/dh.durangoherald.com\/tj\/wp-json\/wp\/v2\/posts\/45021","targetHints":{"allow":["GET"]}}],"collection":[{"href":"https:\/\/dh.durangoherald.com\/tj\/wp-json\/wp\/v2\/posts"}],"about":[{"href":"https:\/\/dh.durangoherald.com\/tj\/wp-json\/wp\/v2\/types\/post"}],"author":[{"embeddable":true,"href":"https:\/\/dh.durangoherald.com\/tj\/wp-json\/wp\/v2\/users\/1"}],"replies":[{"embeddable":true,"href":"https:\/\/dh.durangoherald.com\/tj\/wp-json\/wp\/v2\/comments?post=45021"}],"version-history":[{"count":1,"href":"https:\/\/dh.durangoherald.com\/tj\/wp-json\/wp\/v2\/posts\/45021\/revisions"}],"predecessor-version":[{"id":86317,"href":"https:\/\/dh.durangoherald.com\/tj\/wp-json\/wp\/v2\/posts\/45021\/revisions\/86317"}],"wp:featuredmedia":[{"embeddable":true,"href":"https:\/\/dh.durangoherald.com\/tj\/wp-json\/wp\/v2\/media\/45022"}],"wp:attachment":[{"href":"https:\/\/dh.durangoherald.com\/tj\/wp-json\/wp\/v2\/media?parent=45021"}],"wp:term":[{"taxonomy":"category","embeddable":true,"href":"https:\/\/dh.durangoherald.com\/tj\/wp-json\/wp\/v2\/categories?post=45021"},{"taxonomy":"post_tag","embeddable":true,"href":"https:\/\/dh.durangoherald.com\/tj\/wp-json\/wp\/v2\/tags?post=45021"},{"taxonomy":"naviga_topic","embeddable":true,"href":"https:\/\/dh.durangoherald.com\/tj\/wp-json\/wp\/v2\/naviga_topic?post=45021"}],"curies":[{"name":"wp","href":"https:\/\/api.w.org\/{rel}","templated":true}]}}
