{"id":44553,"date":"2021-09-25T02:53:00","date_gmt":"2021-09-25T08:53:00","guid":{"rendered":"https:\/\/dh.durangoherald.com\/tj\/ax-wielding-man-sentenced-for-felony-assault-in-durango\/"},"modified":"2026-03-31T03:20:12","modified_gmt":"2026-03-31T09:20:12","slug":"ax-wielding-man-sentenced-for-felony-assault-in-durango","status":"publish","type":"post","link":"https:\/\/dh.durangoherald.com\/tj\/ax-wielding-man-sentenced-for-felony-assault-in-durango\/","title":{"rendered":"Ax-wielding man sentenced for felony assault in Durango"},"content":{"rendered":"\n<p>A man living homeless in Durango who assaulted another man with the blunt end of an ax, nearly killing him, was sentenced Friday to four years of probation.<\/p>\n<p>In a letter read into the court record, Roger \u201cArrow\u201d Neal apologized for his actions.<\/p>\n<p><figure class=\"wp-block-image naviga-inline-image naviga-align-left alignleft\"><img decoding=\"async\" src=\"https:\/\/imengine.public.prod.dur.navigacloud.com\/?uuid=f5a113b0-8163-4028-8b0e-f5344b1f8498&amp;function=cover&amp;type=preview&amp;source=false&amp;width=2000\" width=\"1000\" height=\"1333\" alt=\"Neal\" class=\"naviga-image\" loading=\"lazy\"><figcaption><span class=\"caption\">Neal<\/span><span class=\"credit\">du1-i-syn<\/span><\/figcaption><\/figure>\n<\/p><p>\u201cPlease give me another chance for my freedom,\u201d he wrote, according to his public defense lawyer, Mary Pero, who read the letter. \u201cI\u2019ve learned my lesson. I don\u2019t ever want to appear in court in front of you again. I\u2019ll do whatever it takes to complete probation.\u201d<\/p>\n<p>Neal, 34, pleaded guilty to felony assault in a plea agreement with the 6th Judicial District Attorney\u2019s Office.<\/p>\n<p>District Judge William Herringer said he wanted to sentence Neal to community corrections, which would have allowed him to live within the community while maintaining a job. But because he has a pending criminal case, he was ineligible for community corrections.<\/p>\n<p>That left the judge with two options: give Neal probation or send him to prison. The felony assault charge carries a minimum of five years in prison should prison be imposed.<\/p>\n<p><figure class=\"wp-block-image naviga-inline-image naviga-align-left alignleft\"><img decoding=\"async\" src=\"https:\/\/imengine.public.prod.dur.navigacloud.com\/?uuid=d0fce2b7-4c0c-4472-bb28-b4a8a5c2a75e&amp;function=cover&amp;type=preview&amp;source=false&amp;width=2000\" width=\"1000\" height=\"1333\" alt=\"Duran\" class=\"naviga-image\" loading=\"lazy\"><figcaption><span class=\"caption\">Duran<\/span><span class=\"credit\">du1-i-syn<\/span><\/figcaption><\/figure>\n<\/p><p>Herringer said a five-year prison sentence seemed disproportionate compared to what Neal\u2019s co-defendant, Aaron Abraham Duran, received. Duran who participated in the attack, received credit for time served and was released.<\/p>\n<p>Herringer said Duran probably received a sentence that was more lenient than what he deserved, and Neal faced a sentence that was harsher than what he deserved.<\/p>\n<p>\u201cThis presents a difficult situation,\u201d Herringer said.<\/p>\n<p>Pero said Neal has no previous felony convictions and has taken full responsibility for his role. She said Duran instigated the attack, and Neal should not be punished disproportionately to Duran. She asked that her client receive probation.<\/p>\n<p>\u201cThe evidence here and the police reports here talk about how Mr. Duran is the reason for this fight,\u201d Pero said.<\/p>\n<p>Deputy District Attorney Vance Davis asked the court to impose a five-year prison sentence.<\/p>\n<p>According to an arrest affidavit, the assault occurred the afternoon of Feb. 12 in the 3800 block of north Main Avenue.<\/p>\n<p>Callers originally thought the victim had been hit by a car, but it was later learned he had been assaulted by two men. The man was able to identify his attackers as Neal and Duran.<\/p>\n<p>Duran apparently moved in on the victim\u2019s campsite, and the victim told Duran he was no longer welcome at the campsite.<\/p>\n<p>Duran became angry and threatened to kill the victim, according to the affidavit. Later, Duran and Neal, armed with an ax, attacked the victim.
