(Sharon Sullivan for Colorado Newsline)<\/span><span class=\"credit\">cca<\/span><\/figcaption><\/figure>\n<\/p><p>Mesa County will no longer pursue a lawsuit against Clerk and Recorder Tina Peters after she attested to county commissioner documents.<\/p>\n<p>The original lawsuit, filed on Dec. 21, alleged that Peters neglected her duty as clerk by failing to attest to legal action the county\u2019s commissioners took to extend a contract with \u200b\u200bRunbeck Election Services, as first <a href=\"https:\/\/www.gjsentinel.com\/news\/western_colorado\/county-files-lawsuit-against-clerk-peters\/article_ae37ba0e-62a6-11ec-95b1-c7c369f166c5.html\" id=\"link-83094ac58e2e7d35c472518c0d37d4e1\" target=\"_blank\" rel=\"noopener\">reported <\/a>by <em id=\"emphasis-9fbd3aea20c616ff965c2d5beafb0e5b\">The Daily Sentinel<\/em>. The company will print ballots and envelopes for the 2022 primary and general elections.<\/p>\n<p>Though Peters was <a href=\"https:\/\/coloradonewsline.com\/briefs\/judge-rules-mesa-county-clerk-tina-peters-is-barred-from-supervising-november-election\/\" id=\"link-08b28f81cfa18993ffd9a7914e96712c\" target=\"_blank\" rel=\"noopener\">stripped of her status<\/a> to run elections in the county for the 2021 coordinated election, her duties as clerk still involve attesting to documents signed by the board.<\/p>\n<p>The deadline to attest to the voting services contract was Dec. 20, which Peters missed. That prompted the lawsuit.<\/p>\n<p>\u201cPeters finally did attest to the Runbeck contract on Tuesday, Dec. 21, 2021, a week after all other documents were attested, one day after the given deadline and several hours after the county filed the lawsuit with the court,\u201d Mesa County attorney Todd Starr wrote in a statement.<\/p>\n<p>It was necessary to expedite the contract with Runbeck because of a possible shortage of ballot envelopes and inserts next year, county officials said.<\/p>\n<p>\u201cLegally Clerk Peters must attest to BOCC decisions, regardless of personal opinions,\u201d he wrote. \u201cWe are thankful the clerk has complied with her duties, so we don\u2019t have to spend tax dollars on further litigation with the clerk.\u201d<\/p>\n<p>Peters is still facing various investigations into her conduct as clerk and recorder that allowed sensitive passwords to get posted online during a voting system software update, as well as <a href=\"https:\/\/coloradonewsline.com\/briefs\/mesa-tina-peters-new-lawsuit-fundraising-violations\/\" id=\"link-1c2b3baba36ae81e7d4b3f3452d0b9f3\" target=\"_blank\" rel=\"noopener\">lawsuits over alleged<\/a> campaign finance violations.
