{"id":40898,"date":"2022-04-22T23:55:04","date_gmt":"2022-04-23T05:55:04","guid":{"rendered":"https:\/\/dh.durangoherald.com\/tj\/jury-convicts-ignacio-man-of-first-degree-murder-for-shooting-wife-in-head\/"},"modified":"2026-03-31T02:58:00","modified_gmt":"2026-03-31T08:58:00","slug":"jury-convicts-ignacio-man-of-first-degree-murder-for-shooting-wife-in-head","status":"publish","type":"post","link":"https:\/\/dh.durangoherald.com\/tj\/jury-convicts-ignacio-man-of-first-degree-murder-for-shooting-wife-in-head\/","title":{"rendered":"Jury convicts Ignacio man of first-degree murder for shooting wife in head"},"content":{"rendered":"\n<p>An Ignacio man who shot his wife in the head on New Year\u2019s Eve 2020 was found guilty Friday of first-degree murder.<\/p>\n<p>Jurors deliberated about 4\u00bd hours before reaching their verdict.<\/p>\n<p><figure class=\"wp-block-image naviga-inline-image naviga-align-left alignleft\"><img decoding=\"async\" src=\"https:\/\/imengine.public.prod.dur.navigacloud.com\/?uuid=b9557e25-1507-4890-9147-fc0bbdbb0a61&amp;function=cover&amp;type=preview&amp;source=false&amp;width=2000\" width=\"635\" height=\"779\" alt=\"Mathews\" class=\"naviga-image\" loading=\"lazy\"><figcaption><span class=\"caption\">Mathews<\/span><span class=\"credit\">du1-i-syn<\/span><\/figcaption><\/figure>\n<\/p><p>Damon Lamont Mathews showed no obvious signs of emotion as the verdict was read by 6th Judicial District Judge Suzanne Carlson. His public defender, Kellan Schmelz, patted him on the shoulder, and Mathews nodded in the affirmative, as if to show he understood and accepted the verdict.<\/p>\n<p>The 45-year-old man faces a mandatory life-in-prison sentence.<\/p>\n<p>A formal sentencing is set for 1:30 p.m. June 10.<\/p>\n<p>Jurors also found Mathews guilty of felony assault, violation of bail bond conditions and violation of a protection order. He was found not guilty on two charges: intimidation of a victim or witness and retaliation against a witness or victim.<\/p>\n<p>Outside the courtroom, Deputy District Attorney-Appellate Sean Murray indicated he was satisfied with the verdict, but he declined to comment citing a gag order in the case.<\/p>\n<p>\u201cWe are proud to have been able to achieve justice for the victim, her family, and the entire community,\u201d District Attorney Christian Champagne said in an emailed statement.<\/p>\n<p>Mathews gave law enforcement a two-hour video confession, detailing how he strangled his wife before shooting her in the head. But defense attorneys said he acted in the heat of passion, a lesser offense than first-degree murder.<\/p>\n<p><figure class=\"wp-block-image naviga-inline-image\"><img decoding=\"async\" src=\"https:\/\/imengine.public.prod.dur.navigacloud.com\/?uuid=7448c79f-376e-4460-b234-f372adc08468&amp;function=cover&amp;type=preview&amp;source=false&amp;width=2000\" width=\"1444\" height=\"961\" alt=\"Rachel Ream was found dead Jan. 1, 2021, at her home in Ignacio. (Courtesy of Ream family)<\/span><span class=\"credit\">Courtesy of Ream family<\/span><\/figcaption><\/figure>\n<\/p><p>Based on court records and testimony, Mathews had two previous convictions for domestic violence and was facing a third charge when he strangled and shot his wife, Rachel Philips Mathews, 47, who was better known by her last name, Ream.<\/p>\n<p>Mathews was released from jail on Dec. 25, 2020, and two days later began living in the studio apartment behind Ream\u2019s house in violation of a protection order. He and Ream exchanged more than 800 text messages and spent more than eight hours on the phone with each other during a four-day period leading up to the murder.<\/p>\n<p>According to his confession, Mathews and Ream were hanging out together about 11 p.m. Dec. 31 in the studio when they began fighting. Mathews said he tried to put his hand over Ream\u2019s mouth so neighbors wouldn\u2019t hear her and call the police. She bit his hand, so he began strangling her. He told investigators he strangled her for about three minutes. He then went into the main house, retrieved Ream\u2019s 9 mm handgun and returned to the studio apartment. He then shot her once in the head as she lay on the floor.<\/p>\n<p>Defense lawyers conceded Mathews committed crimes that ended his wife\u2019s life, but they said he acted hastily, impulsively and in the heat of passion \u2013 not with intention and premeditation, which are elements of first-degree murder.<\/p>\n<p>\u201cThis is a person who snapped, went blank and acted under a heat of passion, and he\u2019s remorseful,\u201d said public defender Kathryn Polonsky during closing arguments.<\/p>\n<p>But prosecutors said Mathews had plenty of time to form a plan and act on the plan. They called the shooting an \u201cexecution.\u201d He put his hand to her mouth to silence her and then strangled her. Then, realizing the strangulation would probably land him in jail for attempted murder, he decided to end her life, Murray said.<\/p>\n<p>\u201cShooting someone in the head is an execution, it\u2019s that simple,\u201d Murray told jurors. \u201c\u2026 Execution-style killing has but one name in the state of Colorado. \u2026 It\u2019s first-degree murder.\u201d<\/p>\n<p>Ream was a mother of two, cared for a child with special needs and helped raise her sister\u2019s son, said Delta Demain, Ream\u2019s aunt.<\/p>\n<p>\u201cRachel was always there for everybody,\u201d Demain said. \u201cShe was just giving, she would do anything. If anybody needed a place to live or something to eat, she would go out of her way to do that, to fix a meal.\u201d<\/p>\n<p>Demain urged other women experiencing domestic violence to tell someone, seek resources for help and get out of the relationship before it is too late.<\/p>\n<p>\u201cYou hear about it all the time, you know, domestic violence that ends up tragic like that,\u201d she said. \u201cIt\u2019s not a joke. It\u2019s real and it happens way, way too much.\u201d<\/p>\n<p><em id=\"emphasis-d590e67c62d1a578ffd657e09d5a0388\"><a href=\"mailto:shane@durangoherald.com\">shane@durangoherald.com<\/a><\/em><\/p>\n<p><em id=\"emphasis-c68e7228d8c16f694c95015eebd87b88\">A sentencing hearing will be held June 10.
