(Hart Van Denburg\/CPR News file)<\/span><span class=\"credit\">cca<\/span><\/figcaption><\/figure>\n<\/p><p>The Federal Election Commission <a href=\"https:\/\/www.fec.gov\/data\/legal\/matter-under-review\/7876\/\" id=\"link-acc717762a5e7839a4a5faef913f9044\" target=\"_blank\" rel=\"noopener\">dismissed a complaint<\/a> against Colorado GOP Rep. Lauren Boebert about her 2020 mileage reimbursement after the commissioners deadlocked, 3-3, on whether to investigate further.<\/p>\n<p>All three Republican commissioners voted against investigating further, while the two Democrats and one independent commissioner voted in support of the complaint. It takes four votes for the commission to act. Eventually, the independent commissioner sided with Republicans in a decision to dismiss the matter.<\/p>\n<p>While the FEC\u2019s Office of General Counsel, which made recommendations to commissioners before the votes, did not find any evidence that Boebert converted campaign funds to personal use, as the complaint had alleged, it did note that the \u201cround figure of 32,000 miles driven for campaign-related purposes suggests that the assessment is a general estimate rather than one found on the kind of contemporaneous log contemplated in the Commission\u2019s regulations.\u201d<\/p>\n<p>The OGC said the 32,000 number \u201craises questions regarding whether Boebert\u2019s assessment of her campaign-related travel involved the degree of specificity the Commission\u2019s recording regulations require.\u201d<\/p>\n<p>The mileage number could be an underestimate or an overestimate.<\/p>\n<p>\u201cWhat we saw in the vote was the Democrats wanted to get to the bottom of this and see whether or not it was an overestimate, because if it was, then in that case there would have been a law broken. It would have been pocketing campaign cash for personal gain,\u201d said Michael Clauw with the Campaign for Accountability, the nonprofit campaign finance organization that filed the complaint.<\/p>\n<p>He is disappointed with the decision to dismiss \u201ceven though there was further investigation that could be done.\u201d<\/p>\n<p>But the OGC said: \u201cWe do not believe it is worth the use of the Commission\u2019s limited resources to investigate to determine the adequacy of the Boebert Committee\u2019s records.\u201d<\/p>\n<p>The recommendation was to use \u201cprosecutorial discretion,\u201d which Clauw said, \u201cgave Republicans a rationale to block it.\u201d<\/p>\n<p>CPR News asked Boebert\u2019s campaign for comment and has not received a reply.<\/p>\n<p>The Campaign for Accountability filed the complaint after Boebert\u2019s 2020 campaign for Congress paid her $22,259 in mileage reimbursements. Her <a href=\"https:\/\/www.cpr.org\/2021\/02\/24\/rep-lauren-boebert-subtracts-7000-miles-from-her-campaign-claim-saying-she-spent-money-at-hotels-instead\/\" id=\"link-9ac22141b1bb4d4da6d4d5abfb04b907\" target=\"_blank\" rel=\"noopener\">campaign later amended that filing<\/a>, saying that not all the money was for mileage, and instead, it also included hotels and Uber rides.<\/p>\n<p>It\u2019s increasingly common for the commission to deadlock on enforcement cases, said Brett Kappel, a campaign finance lawyer with <a href=\"https:\/\/harmoncurran.com\/\" id=\"link-890a00a38a82fc80ebc54722240a1577\" target=\"_blank\" rel=\"noopener\">Harmon, Curran, Spielberg &amp; Eisenberg<\/a> in Washington, D.C.<\/p>\n<p>But he was surprised that the commission did not investigate the record-keeping decision further.<\/p>\n<p>FEC regulations require all political committees to have records to support the filings they make with the commission, including mileage for when a personal vehicle is used for personal and campaign use.
