(David Zalubowski\/Associated Press file)<\/span><span class=\"credit\">David Zalubowski<\/span><\/figcaption><\/figure>\n<p>DENVER \u2013 Fed up with immense workloads, Colorado\u2019s public defenders launched a unionization drive on Thursday hoping to organize attorneys, paralegals, investigators, social workers, and administrative staff members even though Colorado law blocks them from collective bargaining.<\/p>\n<p>If successful, the Defenders Union of Colorado would join unions in Minnesota and Pennsylvania to become one of the few public defense staff unions in the country.<\/p>\n<p>The effort to organize comes after a chaotic year for courthouses in Colorado, with pandemic delays pushing backlogged jury trials handled by both public and private attorneys up from around 2,700 on a typical year to about 14,600 in 2021, <a href=\"https:\/\/www.denverpost.com\/2021\/04\/18\/colorado-courts-jury-trial-backlog-covid\/\" id=\"link-1\" target=\"_blank\" rel=\"noopener\"><em id=\"emphasis-e8084ed1701977b25d442b578d2d6df0\">The Denver Post<\/em> reported<\/a>.<\/p>\n<p>\u201cEvery day you write yourself this to-do list that can&#8217;t possibly be done in single day,\u201d said Kiyomi Bolick, a lead deputy public defender and co-chair of the organizing committee.<\/p>\n<p>Nearly 40% of regional managers for the state\u2019s public defender\u2019s office left their posts in the last 18 months, Bolick said. \u201cWe are dropping like flies. People need hope. People need a reason to believe this is going to change.\u201d<\/p>\n<p>The same effect has been felt across the country. <a href=\"https:\/\/apnews.com\/article\/covid-health-crime-pandemics-9f479097d57a34907af8629808c46d8c\" id=\"link-2\" target=\"_blank\" rel=\"noopener\">Oregon\u2019s understaffed public defenders office begged<\/a> private attorneys to take cases as some defendants sat jailed without representation for months while <a href=\"https:\/\/apnews.com\/article\/covid-health-minnesota-state-courts-0543ccd3c8a4dc6700a7464effa88e6b\" id=\"link-3\" target=\"_blank\" rel=\"noopener\">Minnesota\u2019s public defenders threatened a strike<\/a> \u2013 a nearly unprecedented action for public defense attorneys \u2013 over high caseloads and low pay in March.<\/p>\n<p>Partly in response to the havoc caused by the pandemic, <a href=\"https:\/\/apnews.com\/article\/us-news-ahmaud-arbery-business-legal-services-health-db65d3202a3a795e6cb65c78c9580121\" id=\"link-4\" target=\"_blank\" rel=\"noopener\">President Joe Biden earlier this year took<\/a> executive action attempting to ensure Americans have better access to legal representation, rebuilding services that decayed during the Trump administration.<\/p>\n<p>In Colorado, Bolick said about 750 employees would be eligible to join the Defenders Union of Colorado, affiliated with the Communications Workers of America, Local 7799.<\/p>\n<p>Even though Colorado law doesn\u2019t offer judicial employees a legal avenue to collectively bargain, \u201cour belief is that no one has to grant a worker the right to unionize,\u201d said Bolick, \u201cthat is fundamental and has been born out of centuries of worker exploitation in our history.\u201d<\/p>\n<p>Maureen Cain, director of external communications for the Office of the Colorado State Public Defender, did not immediately respond to a request for comment.<\/p>\n<p>Those leading the charge hope they can build enough political momentum to pressure the state Legislature to pass a law rolling back that prohibition and codifying the right to organize.<\/p>\n<p>But \u201cthat doesn\u2019t mean we are not allowed to actively take on campaigns to try and improve working conditions while we wait for the Legislature to catch up,\u201d Bolick said.<\/p>\n<p>Similarly, a bill passed earlier this year opened the doors for some county workers in Colorado to unionize without first needing permission from their bosses.<\/p>\n<p>That bill, however, was hard-fought. After receiving pushback from Colorado Gov. Jared Polis, the negotiations shrank the original intent to give more than 250,000 workers the right to unionize down to only 40,000.<\/p>\n<p>Bolick plans for the Defenders Union of Colorado to garner enough members to ratify their own bylaws and hold elections for a more formal structure by the end of the year.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Ostrem, center, who was charged with killing three people at a crowded suburban Denver Walmart, sits with his public defenders during a hearing in Adams County on Nov. 3, 2017, in Brighton.
