(Adrian Hedden\/Carlsbad Current Argus via AP, File)<\/span><span class=\"credit\">Adrian Hedden<\/span><\/figcaption><\/figure>\n<\/p>\n<p>ALBUQUERQUE \u2013 The U.S. government announced <a href=\"https:\/\/apnews.com\/article\/wildlife-business-environment-and-nature-c027951dc698b311e5df46ec693e9b61\" id=\"link-2\" target=\"_blank\" rel=\"noopener\">protections Thursday for two populations of a rare prairie bird<\/a> that\u2019s found in parts of the Midwest, including one of the country\u2019s most prolific oil and gas fields.<\/p>\n<p>The lesser prairie chicken\u2019s range covers a portion of the oil-rich Permian Basin along the New Mexico-Texas state line and extends into parts of Colorado, Oklahoma and Kansas. The habitat of the bird, a type of grouse, has diminished across about 90% of its historical range, officials said.<\/p>\n<p>\u201cThe lesser prairie-chicken\u2019s decline is a sign our native grasslands and prairies are in peril,\u201d said Amy Lueders, Southwest regional director at the U.S. Fish and Wildlife Service.<\/p>\n<p>The crow-size, terrestrial birds are known for spring courtship rituals that include flamboyant dances by the males as they make a cacophony of clucking, cackling and booming sounds. They were once thought to number in the millions, but now, <a href=\"https:\/\/wafwa.org\/wpdm-package\/range-wide-population-size-of-the-lesser-prairie-chicken-2012-to-2021\/?wpdmdl=18495&amp;refresh=63584095d993e1666728085&amp;ind=1629920105054&amp;filename=FINAL%202021%20LEPC%20Range%20Wide%20Report%2020210825.pdf\" id=\"link-3\" target=\"_blank\" rel=\"noopener\">surveys show<\/a>, the five-year average population across the entire range hovers around 30,000.<\/p>\n<p>Environmentalists have sought stronger federal protections for decades. They consider the species severely at risk due to oil and gas development, livestock grazing, farming and the building of roads and power lines.<\/p>\n<p>Republicans in Congress said greater protections weren\u2019t needed and the government instead should rely on voluntary conservation efforts already in place. Kansas\u2019 newly elected Republican attorney general promised to challenge the Fish and Wild Life Service\u2019s decision in court once he takes office in January.<\/p>\n<p>The decision covers the grouse\u2019s southern population in New Mexico and the southern reaches of the Texas Panhandle, where they are considered endangered, and their northern range, where they received the less severe \u201cthreatened\u201d status. The rule takes effect in late January.<\/p>\n<p>Landowners and the oil and gas industry say they have had success with voluntary conservation programs aimed at protecting habitat and boosting the bird\u2019s numbers.<\/p>\n<p>But population estimates reveal that the southern areas have lower resiliency and may have as few as 5,000 birds remaining, with the estimates dropping to as low as 1,000 in 2015 and 2022 following drought conditions, officials said.<\/p>\n<p>The federal government <a href=\"https:\/\/www.govinfo.gov\/content\/pkg\/FR-2014-04-10\/pdf\/2014-07302.pdf\" id=\"link-4\" target=\"_blank\" rel=\"noopener\">in 2014<\/a> classified the bird as a threatened species, but was forced to reverse that two years later after court rulings determined the agency didn\u2019t properly consider the voluntary conservation efforts.<\/p>\n<p>Landowners and oil companies already participating in such programs won\u2019t be affected by Thursday\u2019s decision because they have been taking steps to protect habitat, officials have said. It prevents activities that result in the loss or degradation of existing habitat.<\/p>\n<p>More than 9,375 square miles (24,280 square kilometers) were covered by conservation agreements as of last spring.<\/p>\n<p>\u201cIn their final rule, the U.S. Fish and Wildlife Service first commended landowners\u2019 voluntary efforts to increase lesser prairie-chicken populations in Kansas, and then unilaterally decided that the federal government is better equipped to address these local areas,\u201d Kansas Republican Rep. Tracey Mann of Kansas said in a statement.<\/p>\n<p>A 2014 Kansas law says the state has the sole power to regulate the species \u2013 along with the larger, darker and more abundant greater prairie chicken \u2013 and their habitats within state limits. It authorizes the attorney general or county prosecutors to sue over any federal attempt to enforce conservation measures.<\/p>\n<p>Kansas Attorney General-elect Kris Kobach \u2013 a strong advocate of the 2014 state law when it was enacted \u2013 had predicted during his campaign this year that President Joe Biden\u2019s administration would act on the lesser prairie chicken and said its move \u201cseriously impairs\u201d building wind farms and pushes oil and natural gas production \u201cto the brink of extinction.\u201d<\/p>\n<p>\u201cWhat a surprise they waited until after the election to announce this move!\u201d Kobach said in a statement. \u201cAs attorney general, I will fight this illegal action in court.\u201d<\/p>\n<p>Michael Robinson of the Center for Biological Diversity said having protections for the animals is \u201cterrific\u201d but came too late for prairie chickens in some areas. Robinson\u2019s group sued the government last month because it was five months late in releasing a final decision.
