(Andy Colwell, Special to The Colorado Sun)<\/span><\/figcaption><\/figure>\n<\/p><p>Colorado oil and gas regulators Friday rejected a bid by violation-plagued K.P. Kauffman Co. to delay for another six months an assessment of whether it is meeting a negotiated cleanup plan.<\/p>\n<p>Last June, the Colorado Oil and Gas Conservation Commission staff pressed for penalties for failure to meet the cleanup plan, but the <a href=\"https:\/\/coloradosun.com\/2022\/06\/28\/colorado-gives-oil-and-gas-company-6-more-months-to-clean-up-its-act-if-not-kp-kauffman-faces-nearly-1-million-in-fines-or-worse\/\" id=\"link-ede1ce92e3e69a39465823a02a890663\" target=\"_blank\" rel=\"noopener\">commission agreed to give the company<\/a>, which operates about 1,200 low-producing wells, another six months.<\/p>\n<p>However, in granting the extension Commission Chairman Jeff Robbins said it was time for the company to \u201ccomply from the top down or not, and if it is \u2018or not,\u2019 I am ready to throw the book at them.\u201d<\/p>\n<p>That six-month assessment is scheduled for Jan. 25, but KPK filed a request for another six months while it negotiates the sale of its Spindle Field assets, 68,000 acres of leases and hundreds of wells in northeastern Colorado, to a larger operator.<\/p>\n<p>That larger \u2013 undisclosed \u2013 operator\u2019s plan would be to pump carbon dioxide into the old field to enhance oil recovery and also serve as a <a href=\"https:\/\/coloradosun.com\/2022\/05\/12\/carbon-capture-colorado-ethanol-plants-greenhouse-gas-emissions\/\" id=\"link-d4f9b1013b167ff18643ea085ba1fb76\" target=\"_blank\" rel=\"noopener\">carbon capture and sequestration project<\/a>.<\/p>\n<p>The sale would reduce KPK\u2019s number of old wells, improve its financial positions and \u201cwould serve to more quickly and effectively address this commission\u2019s concerns,\u201d John Jacus, the company\u2019s attorney, told the commissioners.<\/p>\n<p>Proceeding with the enforcement review and possible penalties could hamper the sale of the oil field and the remediation project, Jacus said.<\/p>\n<p>The motion was opposed by the COGCC staff, which through its attorney, Assistant Attorney General Caitlin Stafford, said that KPK is falling behind its negotiated 2021 plan to clean up 74 sites.<\/p>\n<p>The agreement was the result of an enforcement action on 20 alleged violations at seven sites and came <a href=\"https:\/\/coloradosun.com\/2021\/05\/28\/kp-kauffman-oil-spills\/\" id=\"link-b841c42e642864185db95cb6c32496a8\" target=\"_blank\" rel=\"noopener\">after 87 wells were ordered closed for violations earlier in 2021<\/a>.<\/p>\n<p>The company was fined $2 million, but allowed to pay $795,000 \u2013 all KPK said it could afford \u2013 provided it adhered to its cleanup plan.<\/p>\n<p>Stafford told the commission that the company is not meeting its obligations.<\/p>\n<p>\u201cKPK is making little progress in addressing its multitude of core remediation projects subject to the compliance plan agreement,\u201d she said. \u201cSince June, and as we will likely discuss at the upcoming hearing, KPK has closed only one more remediation project \u2026 bringing their total to three out of 58 remediation projects.\u201d<\/p>\n<p>Jacus said that the company is prepared to show that it is making progress on the plan and has spent $7 million on remediation.<\/p>\n<p>Robbins asked for more details on the potential sale, but Jacus said that negotiations were confidential and constrained by nondisclosure agreements.<\/p>\n<p>The oil field sale and carbon project \u201ccould have a positive impact for the commission and the state of Colorado by helping to reduce greenhouse emissions, but based on the lack of information about the sale, transfer and future plans for the Spindle Field, much of this seems speculative,\u201d Stafford said.<\/p>\n<p>The commission unanimously rejected KPK\u2019s request.<\/p>\n<p>\u201cHow does a continuance ensure environmental protection for the remaining spills that are ongoing?\u201d Robbins asked.<\/p>\n<p>Commissioner Mike Cross questioned whether moving ahead with this week\u2019s hearing and even levying sanctions for noncompliance would jeopardize the proposed oil field sale.<\/p>\n<p>\u201cIt sounds to me as though this is kind of a roundabout way of saying we don\u2019t want to have the hearing next week, because if we were to have any kind of sanctions levied against us, we would potentially have a sale price that would be lower,\u201d Cross said. \u201cAnd that is not our job to protect the sale price of any kind of assets.\u201d<\/p>\n<p>Continued and regular hearings and oversight of KPK\u2019s cleanup plan were \u201cimperative to the integrity of the compliance process,\u201d Commissioner Brett Ackerman said.<\/p>\n<p><a href=\"https:\/\/coloradosun.com\/\" id=\"link-3\" target=\"_blank\" rel=\"noopener\">The Colorado Sun is a reader-supported, journalist-owned news outlet exploring issues of statewide interest.
