Lauren Boebert of Silt in federal court in Colorado, the activist told Newsline.<\/p>\n<p>David Wheeler, president of the American Muckrakers PAC, <a href=\"https:\/\/coloradonewsline.com\/briefs\/lauren-boebert-sued-for-libel-american-muckrakers\/\" id=\"link-667cdf83449fcc29832f459aebafea7a\" target=\"_blank\" rel=\"noopener\">sued Boebert<\/a> in a North Carolina state court last year for defamation and malicious prosecution. In January, the judge <a href=\"https:\/\/www.citizen-times.com\/story\/news\/2023\/02\/07\/wnc-pacs-suit-against-boebert-dismissed-may-sue-in-colorado\/69878289007\/\" id=\"link-3f9e4ac51a5fa3a111a2e7e2abd3e96a\" target=\"_blank\" rel=\"noopener\">dismissed the case<\/a>, saying that the proper venue for it was in Colorado.<\/p>\n<p>Wheeler said he\u2019s heeding the judge\u2019s advice and is poised to bring a similar lawsuit against Boebert in Colorado, though now he plans to file in federal court.<\/p>\n<p>Wheeler said he\u2019s looking to depose Boebert on video about her involvement in the Jan. 6 insurrection and numerous other matters related to the case. \u201cIt would certainly be in the public interest to be able to see that videotape,\u201d he said.<\/p>\n<p>And the defamation case may be expanded to include more defendants, like Fox News and Sean Hannity, he said.<\/p>\n<p>American Muckrakers is widely credited with damaging the electoral prospects of former Republican U.S. Rep. Madison Cawthorn of North Carolina after Muckrakers released <a href=\"https:\/\/www.nytimes.com\/2022\/04\/29\/us\/politics\/madison-cawthorn.html\" id=\"link-9673f9a55650b27aa6c506fbd7e6e98f\" target=\"_blank\" rel=\"noopener\">unflattering video<\/a> of the congressman, who lost his reelection bid after a primary defeat. The political action committee later turned its attention to Boebert and started publishing information about her with the explicit intention of spoiling her reelection effort.<\/p>\n<p>Boebert spokesman Ben Stout declined to comment for this story, but he referred Newsline to a CN<a href=\"https:\/\/www.cnn.com\/2022\/06\/25\/politics\/fact-check-super-pac-lauren-boebert-escort-abortion-sugar-daddy\/index.html\" id=\"link-d7386ae99511786b3a5eccb7186e664f\" target=\"_blank\" rel=\"noopener\">N article la<\/a>st year that debunked many of Muckrakers\u2019 claims, and he said that Wheeler was already unsuccessful in the North Carolina case.<\/p>\n<p>Last year, Wheeler and Muckrakers <a href=\"https:\/\/www.fireboebert.com\/\" id=\"link-fc692baff4815a8405310bbad7b352dd\" target=\"_blank\" rel=\"noopener\">published information<\/a> they said was gathered from sources close to Boebert, though some of the claims <a href=\"https:\/\/www.denverpost.com\/2022\/06\/15\/lauren-boebert-allegations\/\" id=\"link-5c8cd77bb52c14c6b71d644e5bc36680\" target=\"_blank\" rel=\"noopener\">lacked<\/a> corroborating evidence. They announced that sources revealed personal information about Boebert that appeared to run counter to her political stance against abortion, among other allegations. In subsequent statements and on media appearances, including on Hannity\u2019s show, Boebert accused Wheeler and Muckrakers of publishing \u201cfalse statements knowing they were completely fabricated,\u201d characterized the statements as \u201cdefamation,\u201d and said she was \u201cmoving forward with a lawsuit.\u201d<\/p>\n<p>A lawsuit from Boebert never came. But Wheeler\u2019s did. In the North Carolina defamation case, Wheeler said donations to the Muckrakers PAC went into free fall, and his own income, which came solely from Muckrakers, took a huge hit. He also said Boebert engaged in false prosecution after she filed for a temporary protective order against Wheeler and indicated in court documents that he engaged in \u201cphysical and verbal threats\u201d against her \u2013 allegations he denies. A court in August <a href=\"https:\/\/www.gjsentinel.com\/news\/western_colorado\/court-rejects-boeberts-request-for-protection-order\/article_9de461e4-0f75-11ed-944e-4f6d50936864.html\" id=\"link-6784872ed56f5f68c71acc65bee1df16\" target=\"_blank\" rel=\"noopener\">rejected<\/a> Boebert\u2019s request for a protection order.<\/p>\n<p>Though some of American Muckrakers\u2019 claims about Boebert turned out to be <a href=\"https:\/\/www.cnn.com\/2022\/06\/25\/politics\/fact-check-super-pac-lauren-boebert-escort-abortion-sugar-daddy\/index.html\" id=\"link-144bc0e718ea6e281a6fb4bb97852286\" target=\"_blank\" rel=\"noopener\">false<\/a>, Wheeler stands by the main components of its case against the congresswoman.<\/p>\n<p>He said that the judge in North Carolina dismissed the case only on the question of jurisdiction.<\/p>\n<p>\u201cHe didn\u2019t dismiss it on the merits, and he could have, because that was part of (Boebert\u2019s) request for dismissal,\u201d Wheeler said.<\/p>\n<p>The decision to file in the U.S. District Court of Colorado is largely to get around the question of jurisdiction, he said, since Wheeler expects that if he filed a case in a state court, Boebert would seek to move the case to a federal court.<\/p>\n<p>He said Hannity and Fox News could be defendants in the new defamation claim, because they \u201cwent after me pretty heavily,\u201d saying Wheeler knowingly published falsehoods about Boebert.<\/p>\n<p>\u201cHow they would know what I was thinking will be the issue,\u201d Wheeler said. \u201cBecause everything that we published and put out was based upon what we were told, either in writing in documents or in recorded phone calls.\u201d<\/p>\n<p>Wheeler is working on the case with Denver attorney Dan Ernst, who specializes in defamation.<\/p>\n<p>\u201cWe did contact Fox, and specifically the Hannity program. And they were explicitly not responsive. They weren\u2019t open to David\u2019s overtures about correcting the record,\u201d Ernst told Newsline on Wednesday.<\/p>\n<p>Newsline contacted a Fox News communications executive seeking comment but had not received a response by the time of publication.<\/p>\n<p>Among Wheeler\u2019s goals is getting Boebert on record regarding her involvement in the Jan. 6 insurrection, he said. Boebert <a href=\"https:\/\/coloradonewsline.com\/2021\/01\/22\/the-most-important-speech-of-boeberts-life-annotated\/\" id=\"link-d27dcd6be95c6d15bd703ef5c0fa1f66\" target=\"_blank\" rel=\"noopener\">allied herself<\/a> with the mob of supporters of former President Donald Trump that stormed the U.S. Capitol, and Cassidy Hutchinson, a former top White House aide, in <a href=\"https:\/\/coloradonewsline.com\/briefs\/boebert-white-house-jan-6-planning\/\" id=\"link-ce2ce0d2df2a6dab9b6596ba615bf5e6\" target=\"_blank\" rel=\"noopener\">congressional testimony<\/a> identified Boebert as one of a small group of Republican lawmakers who was involved in the beginning stages of talks with Trump officials on how to decertify 2020 election results.<\/p>\n<p>\u201cWhat was her involvement in that \u2013 on the record under oath?
