Journal file photo<\/span><span class=\"credit\">du1-i-syn<\/span><\/figcaption><\/figure>\n<\/p>\n<p>In August, Cortez Municipal Court launched an outreach court to help address the underlying issues that bring about crime and time in the courtroom.<\/p>\n<p>Some of the issues the municipal court cited were housing instability, mental health and\/or substance abuse, and they noted that they are modeling this program after the American Bar Association\u2019s Homeless Court Program.<\/p>\n<p>\u201cIf someone\u2019s picking up quite a few alcohol-related offenses, we help them address that. And we hope they would want to address their alcohol use so that then they\u2019re not coming in the courtroom anymore,\u201d Cortez Municipal Judge Beth Padilla told <em id=\"emphasis-5cf216a1837764031e03e7903fcbec44\">The Journal.<\/em><\/p>\n<p>\u201cIt\u2019s a completely voluntary program,\u201d she said. \u201cI don\u2019t order them to address substance use, I don\u2019t order them to address housing. I say, \u2018Your three options are housing, mental health or substance use. What do you want to work on and what agency are you going to partner with to reach your goals?\u2019\u201d<\/p>\n<p><figure class=\"wp-block-image naviga-inline-image naviga-align-left alignleft\"><img decoding=\"async\" src=\"https:\/\/imengine.public.prod.dur.navigacloud.com\/?uuid=a2f3b630-11ed-5e25-9fe1-c7d4d798ee90&amp;function=cover&amp;type=preview&amp;source=false&amp;width=2000\" width=\"680\" height=\"1022\" alt=\"Beth Padilla was sworn in as a Municipal Court Judge in 2021.\" class=\"naviga-image\" loading=\"lazy\"><figcaption><span class=\"caption\">Beth Padilla was sworn in as a Municipal Court Judge in 2021.<\/span><span class=\"credit\">Courtesy City of Cortez<\/span><\/figcaption><\/figure>\n<\/p><p>According to the American Bar, Cortez is \u201cthe first municipality in Colorado to implement their model.\u201d<\/p>\n<p>In this program, any person with a pending case, outstanding court costs or fines and\/or suspended jail sentence are eligible. Meetings take place on the first Monday of the month at 11 a.m. The program is 90 days in total.<\/p>\n<p>This is a voluntary program, and it is up to the defendant to decide whether they want to participate. To join the program, the defendant informs the court of their decision, and will then work with the program\u2019s hub, Pi\u00f1on Project, to \u201cdetermine the agency they will utilize to address the issue.\u201d<\/p>\n<p>Padilla said she believes about 20 defendants have enrolled in the program.<\/p>\n<p>\u201cIf the person wants to work on their alcohol use, I would say, \u2018OK, do you want to work with the recovery center or Axis?\u2019 Or if they\u2019re a member of the Ute Mountain Ute Tribe, \u2018Do you want to work with someone from your tribe?\u2019\u201d Judge Padilla said.<\/p>\n<p>If the defendant doesn\u2019t complete the program in its entirety or to the satisfaction of program leaders, or they decide they don\u2019t want to complete the program, they will return to a normal docket.<\/p>\n<p>\u201cOutreach court is really allowing defendants to address the issues that they believe are causing the problems,\u201d Padilla said.<\/p>\n<p><figure class=\"wp-block-image naviga-inline-image\"><img decoding=\"async\" src=\"https:\/\/imengine.public.prod.dur.navigacloud.com\/?uuid=243318cf-0fd0-4a4d-b18f-5c32fb046c69&amp;function=cover&amp;type=preview&amp;source=false&amp;width=2000\" width=\"2000\" height=\"1397\" alt=\"Carla Odell works from her municipal office in the Cortez City Hall building. (Journal file photo)<\/span><span class=\"credit\">du1-i-syn<\/span><\/figcaption><\/figure>\n<\/p><p>After registering, the defendant agrees to work with the agency to which they are assigned for 90 days to address whatever issues are deemed in need of intervention, and the cases are then placed into a diversionary status.<\/p>\n<p>\u201cIf the defendant successfully completes the treatment program the case will be dismissed; however, if they do not complete the program the case will return to the normal docket.
