{"id":24916,"date":"2024-11-08T16:46:49","date_gmt":"2024-11-08T23:46:49","guid":{"rendered":"https:\/\/dh.durangoherald.com\/tj\/trinadie-lopez-sentenced-to-six-years-for-2023-street-shooting\/"},"modified":"2026-03-30T23:04:54","modified_gmt":"2026-03-31T05:04:54","slug":"trinadie-lopez-sentenced-to-six-years-for-2023-street-shooting","status":"publish","type":"post","link":"https:\/\/dh.durangoherald.com\/tj\/trinadie-lopez-sentenced-to-six-years-for-2023-street-shooting\/","title":{"rendered":"Trinadie Lopez sentenced to six years for 2023 street shooting"},"content":{"rendered":"<p><figure class=\"wp-block-image naviga-inline-image\"><img decoding=\"async\" src=\"https:\/\/imengine.public.prod.dur.navigacloud.com\/?uuid=0cd1fd82-e89f-507d-95ac-cde92726e2a6&amp;function=cover&amp;type=preview&amp;source=false&amp;width=2000\" width=\"1058\" height=\"858\" alt=\"\" class=\"naviga-image\" loading=\"lazy\"><\/figure>\n<\/p>\n<p>Trinadie Xander Lopez, 20, was sentenced Thursday to six years in the Colorado Department of Corrections Youthful Offenders System and 12 months probation after last year\u2019s street shooting that severely injured bystander Josilyn Mark, 19.<\/p>\n<p>Noah Farrar allegedly was the target.<\/p>\n<p>The sentencing, which was scheduled for the end of October, was reset to Thursday morning after one of the provisions in the plea agreement had not been met. According to 22nd Judicial Disitrict Chief Judge Todd Plewe, the plea agreement had stipulated that Lopez would give a \u201cfull and accurate account\u201d of the events that took place on Sept. 15, 2023.<\/p>\n<p>He pleaded guilty to felony menacing Aug. 27.<\/p>\n<p>District Attorney Christian Hatfield and defense attorney Kent Pace told Plewe that Lopez was able to give that account on Tuesday and everyone was \u201csatisfied\u201d with his account.<\/p>\n<p>\u201cI tend to believe him and know more than before,\u201d Hatfield said, adding that now he was more convinced that Lopez was not the one who fired the gun that day.<\/p>\n<p>Eva Martinez, Mark\u2019s grandmother, addressed Plewe, telling the court that it\u2019s been \u201ca journey\u201d since the night Mark was shot.<\/p>\n<p>\u201cThey had to save her life,\u201d she said.<\/p>\n<p>Mark, who had just graduated from high school and was preparing for the Army, soon found herself fighting for her life. Now, she is suffering mental, physical and emotional pain. She is missing a portion of her leg and is still undergoing treatment, Martinez said.<\/p>\n<p>Martinez added that Mark is \u201ca different girl\u201d who is \u201cfearful and trusts no one.\u201d She asked the court to be \u201cmindful of what she went through\u201d and will continue to experience for the rest of her life because of the shooting.<\/p>\n<p>She also addressed Lopez.<\/p>\n<p>\u201cMy heart breaks for you, too,\u201d she said, acknowledging that he wasn\u2019t the only one in the car. \u201cYou destroyed a life no matter what part you took in it.\u201d<\/p>\n<p>Pace spoke next, once again alleging that Lopez was the target of \u201cgang activity.\u201d He told Plewe that the group in question had threatened Lopez before and that Lopez believed that his life \u201cwas in danger.\u201d<\/p>\n<p>\u201cThat does not justify him bringing an assault rifle when the people he was with were planning on using it,\u201d Pace said.<\/p>\n<p>He added that Lopez wasn\u2019t a \u201cfully formed adult\u201d and that he didn\u2019t have previous criminal history \u201cof any significance.\u201d Since the shooting, Lopez has been working toward his GED.<\/p>\n<p>\u201cMr. Lopez, I think, deserves a second chance,\u201d Pace said.<\/p>\n<p>Pace then ended his comments by reading a letter of apology Lopez wrote to Mark and the community.<\/p>\n<p>\u201cI pray to God she can forgive me someday,\u201d the letter said. Lopez also expressed his desire to be a better example for his brothers and sisters.<\/p>\n<p>Lopez\u2019s family addressed the court next, with his sister, mother, girlfriend, grandmothers and grandfather speaking to Plewe.<\/p>\n<p>His family detailed their relationship with Lopez, sharing that being without him had been difficult for them. They said he is a \u201cgood person.\u201d<\/p>\n<p>\u201cIt\u2019s really hard to see my son like this,\u201d Lopez\u2019s mother said.<\/p>\n<p>Lopez followed his family, apologizing first to Mark and Martinez.<\/p>\n<p>\u201cI pray every day that Josilyn\u2019s leg heals,\u201d he said. \u201cI just want to apologize to everyone.\u201d<\/p>\n<p>He also addressed the others who had been in the vehicle the night of the shooting, saying he wished that they would take responsibility for \u201ctheir part.\u201d<\/p>\n<p>\u201cI wish I could go back to that day and take it back, but I can\u2019t,\u201d he said.<\/p>\n<p>Plewe said he believed Lopez that he wasn\u2019t the one who fired the weapon, but that he would still have to bear the consequences for bringing the gun. He said he had seen Mark\u2019s \u201chorrific\u201d injuries.<\/p>\n<p>\u201cShe almost died,\u201d Plewe said. \u201cShe is physically and mentally harmed for life. \u2026 You chose that day to get an assault rifle and put it in the vehicle.\u201d<\/p>\n<p>Mark will be \u201cdisabled to some degree for life\u201d and the community was \u201cdamaged,\u201d Plewe said.<\/p>\n<p>Plewe then addressed Hatfield, saying that he was concerned that Delsin Freeman had not been charged, though he remains in federal custody. He asked Hatfield if charges would come in Freeman\u2019s part of the case.<\/p>\n<p>\u201cIt may come to pass or it may not come to pass,\u201d Hatfield said.<\/p>\n<p>Plewe sentenced Lopez to six years in the Colorado DOC Youth Offenders System, saying that he believed a six-year sentence was \u201cappropriate.\u201d After the six years, he will have 12 months of probation.
