He is charged with two counts of third-degree felony criminal sexual contact of a minor under age 13.<\/p>\n<p>The charges against Nunez are in connection to two incidents that allegedly occurred at the end of the 2023-2024 school year at Hermosa Middle School, where Nunez was working as a substitute, according to the arrest affidavit.<\/p>\n<p>Two female students reported the alleged incidents to the social worker at the school, and she reported it to the Farmington Police Department, which opened an investigation.<\/p>\n<p>Both girls reported allegations of inappropriate conversations and touching on the part of Nunez. This included Nunez reportedly asking one of the girls for her Snapchat account and letting \u201chis hand rest onto her breast over her clothing,\u201d the affidavit states.<\/p>\n<p>The child disclosed that \u201cshe felt uncomfortable,\u201d so she got up from her desk \u201cgrabbed a tissue and threw it into the trash,\u201d but Nunez reportedly approached again, so \u201cshe asked to use the restroom\u201d and left the classroom, the affidavit states.<\/p>\n<p>The second child accused Nunez of standing beside her and reportedly putting his left arm around her and placing his left hand on her breast, according to the affidavit for arrest warrant.<\/p>\n<p>The child said, \u201cshe grabbed his wrist to shove his hand away,\u201d and then \u201cused her right shoulder to push off him and walk away,\u201d the affidavit says.<\/p>\n<p>The child said it made her feel \u201cuncomfortable, weird and she did not know what to do,\u201d and that \u201cthis had not happened before,\u201d the affidavit says.<\/p>\n<p>Both girls underwent forensic interviews after disclosing this information to the social worker and the police. Investigators stated in the affidavit that the stories remained consistent.<\/p>\n<p>Nunez was placed on leave by Farmington Schools \u201cuntil the legal process is complete,\u201d according to FMS spokesman Robert Taboada.<\/p>\n<p>Then, on June 18, 2024, Nunez defense attorney Alexandra Jones, based out of Albuquerque, filed a motion stating she had \u201ca good faith belief\u201d Nunez was not competent to stand trial.<\/p>\n<p>Jones believed a \u201ctraumatic brain injury,\u201d suffered by Nunez as a child impaired his ability \u201cto understand the charges,\u201d according to the motion.<\/p>\n<p>Jones also stated that Nunez \u201cdoes not recall recent events, and cannot assist with his defense,\u201d according to the motion.<\/p>\n<p>Once competency was raised, the case was sealed and transferred to district court.<\/p>\n<p>Nunez underwent a forensic evaluation to determine competency and on Oct. 25, District Court Judge Curtis Gurley found Nunez competent to stand trial and remanded the case back to the Farmington Magistrate Court for a preliminary hearing.<\/p>\n<p>The hearing will be at 1:30 p.m. Jan. 14 in front of Magistrate Erich Cole.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Preliminary hearing set this week in Jose Nunez case<\/p>\n","protected":false},"author":1,"featured_media":24075,"comment_status":"open","ping_status":"open","sticky":false,"template":"","format":"standard","meta":{"_acf_changed":false,"footnotes":""},"categories":[],"tags":[28],"naviga_topic":[],"class_list":["post-24074","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","tag-headlines"],"acf":[],"author_name":"dh_admin","_links":{"self":[{"href":"https:\/\/dh.durangoherald.com\/tj\/wp-json\/wp\/v2\/posts\/24074","targetHints":{"allow":["GET"]}}],"collection":[{"href":"https:\/\/dh.durangoherald.com\/tj\/wp-json\/wp\/v2\/posts"}],"about":[{"href":"https:\/\/dh.durangoherald.com\/tj\/wp-json\/wp\/v2\/types\/post"}],"author":[{"embeddable":true,"href":"https:\/\/dh.durangoherald.com\/tj\/wp-json\/wp\/v2\/users\/1"}],"replies":[{"embeddable":true,"href":"https:\/\/dh.durangoherald.com\/tj\/wp-json\/wp\/v2\/comments?post=24074"}],"version-history":[{"count":1,"href":"https:\/\/dh.durangoherald.com\/tj\/wp-json\/wp\/v2\/posts\/24074\/revisions"}],"predecessor-version":[{"id":78387,"href":"https:\/\/dh.durangoherald.com\/tj\/wp-json\/wp\/v2\/posts\/24074\/revisions\/78387"}],"wp:featuredmedia":[{"embeddable":true,"href":"https:\/\/dh.durangoherald.com\/tj\/wp-json\/wp\/v2\/media\/24075"}],"wp:attachment":[{"href":"https:\/\/dh.durangoherald.com\/tj\/wp-json\/wp\/v2\/media?parent=24074"}],"wp:term":[{"taxonomy":"category","embeddable":true,"href":"https:\/\/dh.durangoherald.com\/tj\/wp-json\/wp\/v2\/categories?post=24074"},{"taxonomy":"post_tag","embeddable":true,"href":"https:\/\/dh.durangoherald.com\/tj\/wp-json\/wp\/v2\/tags?post=24074"},{"taxonomy":"naviga_topic","embeddable":true,"href":"https:\/\/dh.durangoherald.com\/tj\/wp-json\/wp\/v2\/naviga_topic?post=24074"}],"curies":[{"name":"wp","href":"https:\/\/api.w.org\/{rel}","templated":true}]}}
