It is alleged Armijo walked up to Corey Washburn, 44, and stabbed him in the stomach \u201cjust under his right rib cage,\u201d according to the statement of probable cause.<\/p>\n<p>Armijo claimed to police that Washburn jumped him, so he stabbed him, but his claims were unsubstantiated, and Farmington Police arrested Armijo and charged him with aggravated battery, according to the statement.<\/p>\n<p>Armijo was released from the jail on July 16 despite other violent crimes on his record. Allen said he tried to walk away but was attacked and stabbed \u201cin the neck and face,\u201d the affidavit says.<\/p>\n<p>During the competency hearing, Farmington Police Detective Eduardo Arreola, stated that Armijo admitted to stabbing Allen and did so because he thought Allen was a \u201cchild molester.\u201d<\/p>\n<p>He also reportedly told the detective that his family members \u201cwere called child molesters\u201d and were \u201cpart of (the) satanic church.\u201d<\/p>\n<p>Armijo also reportedly told Dr. Harrington that \u201ca family member is married to someone in a drug cartel,\u201d but \u201che is not involved with the Mexican Mafia,\u201d Assistant District Attorney Joseph Patrelli stated, according to the audio log notes.<\/p>\n<p><figure class=\"wp-block-image naviga-inline-image\"><img decoding=\"async\" src=\"https:\/\/imengine.public.prod.dur.navigacloud.com\/?uuid=95e35e26-c606-55e3-a8e9-3695b4dd4bf7&amp;function=cover&amp;type=preview&amp;source=false&amp;width=2000\" width=\"826\" height=\"543\" alt=\"This Farmington Police Department photo shows the area, where a stabbing occurred on July 22 on the Berg Park Riverwalk.\" class=\"naviga-image\" loading=\"lazy\"><figcaption><span class=\"caption\">This Farmington Police Department photo shows the area, where a stabbing occurred on July 22 on the Berg Park Riverwalk.<\/span><span class=\"credit\">cca<\/span><\/figcaption><\/figure>\n<\/p><p>Eight hours after the stabbing, Armijo walked to his family home in the 1800 block of York Avenue, where he reportedly attacked his uncle, Virgil Canuto, the affidavit states.<\/p>\n<p>Armijo reportedly told police he \u201ctried to kill his uncle\u201d by stabbing him, shooting him with a \u201cpellet-style air gun\u201d firing a \u201ccopper-head\u201d pellet into his back to paralyze him, the affidavit states.<\/p>\n<p>Patrelli stated in court that while the DA\u2019s office believes Armijo has \u201csome paranoia,\u201d it would not be enough to commit him. This is because he \u201cresponds to questions and explains why he did what he did.\u201d<\/p>\n<p>Defense Attorney Ian Jump, who raised competency on Aug. 15, 2024, stated, \u201cjust because he can give a story or events does not mean it\u2019s rational.\u201d<\/p>\n<p><figure class=\"wp-block-image naviga-inline-image\"><img decoding=\"async\" src=\"https:\/\/imengine.public.prod.dur.navigacloud.com\/?uuid=f0c572dd-58f6-5362-9142-4ec31e35cc4c&amp;function=cover&amp;type=preview&amp;source=false&amp;width=2000\" width=\"825\" height=\"542\" alt=\"This crime photo from the Farmington Police Department shows where the knife reportedly used in a July 22 stabbing on the Berg Park Riverwalk was discarded.\" class=\"naviga-image\" loading=\"lazy\"><figcaption><span class=\"caption\">This crime photo from the Farmington Police Department shows where the knife reportedly used in a July 22 stabbing on the Berg Park Riverwalk was discarded.<\/span><span class=\"credit\">cca<\/span><\/figcaption><\/figure>\n<\/p><p>Jump pointed out during the hearing that when Armijo was questioned by Arreola he was \u201ctalking to himself, punching air,\u201d and claimed, \u201ceverything is related to a child molester.\u201d<\/p>\n<p>Jump asked, \u201ctaking all that together do you still think he was giving thoughtful statements?\u201d<\/p>\n<p>Arreola stated, \u201cyes.\u201d<\/p>\n<p>Harrington when questioned stated that while Armijo told him he \u201cunderstood\u201d his Miranda Rights, Armijo \u201cwas paranoid, agitated\u201d and then, started talking about things outside of the conversation and it had a \u201cjarring irrational quality.\u201d<\/p>\n<p>Jump attempted to call Armijo to the stand during the hearing, but Armijo refused to swear-in.<\/p>\n<p>Patrelli stated that just because Armijo would not cooperate with policies or his evaluation it does not mean he is incompetent.<\/p>\n<p>He said that just because Armijo is \u201cmentally disturbed\u201d it would not hinder his ability to \u201cunderstand and assist\u201d with his defense.<\/p>\n<p>Jump stated that Armijo\u2019s \u201cthoughts are jumbled\u201d in the video of him being questioned by police and he speaks of \u201cchild molestation\u201d and \u201cconspiracy,\u201d so he \u201cshould go to the state hospital.\u201d<\/p>\n<p>The \u201ccourt finds that the defendant is incompetent,\u201d District Judge Curtis Gurley said.<\/p>\n<p>Patrelli asked that Armijo be committed for the entire length of his sentence should he have been found guilty of the crimes for which he was charged.<\/p>\n<p>Gurley asked him to write the order, which is sealed by the court.<\/p>\n<p>Gurley also filed a notice of federal restriction on the right to possess or receive a firearm or ammunition.
