(Durango Herald file)<\/span><span class=\"credit\">du1-i-syn<\/span><\/figcaption><\/figure>\n<\/p><p>A judge declared a mistrial Wednesday after jurors deadlocked in the case of an Arizona man accused of fatally shooting an Ignacio resident 16 years ago.<\/p>\n<p>The jury deliberated for a day and half before 6th Judicial District Judge Kim Shropshire declared a mistrial.<\/p>\n<p>Larry Fuller, 49, was found collapsed on an Ignacio sidewalk in the early morning hours of Jan. 1, 2009, after being shot once in the face.<\/p>\n<p><figure class=\"wp-block-image naviga-inline-image naviga-align-left alignleft\"><img decoding=\"async\" src=\"https:\/\/imengine.public.prod.dur.navigacloud.com\/?uuid=c0be0a8c-d013-5cc9-8dc3-319247f93329&amp;function=cover&amp;type=preview&amp;source=false&amp;width=2000\" width=\"707\" height=\"711\" alt=\"Hendren\" class=\"naviga-image\" loading=\"lazy\"><figcaption><span class=\"caption\">Hendren<\/span><span class=\"credit\">cca<\/span><\/figcaption><\/figure>\n<\/p><p>David Hendren, 39, was arrested in 2023 in connection with the death, nearly 14 years after the case went cold.<\/p>\n<p>Prosecutors argued Hendren shot Fuller after mistaking him for the man Hendren\u2019s brother had fought with earlier.<\/p>\n<p>The defense said Hendren did not pull the trigger and that the state\u2019s theory did not match the evidence.<\/p>\n<p>Jurors began deliberating about 8:30 a.m. Tuesday and by Wednesday had reached three standstills.<\/p>\n<p>Around noon Wednesday, they informed the court of their third standstill in a written question to the judge: \u201cAfter deliberating we cannot come to a unanimous decision and have nothing else to deliberate on, what do we do next?\u201d<\/p>\n<p>The prosecution responded by advocating for the use of a modified Allen charge, a jury instruction designed to encourage deadlocked jurors to reach an agreement.<\/p>\n<p>The defense objected and asked for the murder charge against Hendren to be dropped.<\/p>\n<p>The 16-year gap between Fuller\u2019s death and Hendren\u2019s trial posed challenges for prosecutors while strengthening the defense\u2019s case.<\/p>\n<p>Many of the prosecution\u2019s witnesses had been drinking with Hendren and Fuller on the night of Fuller\u2019s death.
