Albuquerque attorney Jason Bowles is representing Wilkerson\u2019s brother, Zach Wilkerson, in both state and federal tort claims.<\/p>\n<p>Family members allege wrongful death by the marshals and seek monetary damages for the loss of their loved ones.<\/p>\n<p><figure class=\"wp-block-image naviga-inline-image\"><img decoding=\"async\" src=\"https:\/\/imengine.public.prod.dur.navigacloud.com\/?uuid=61b9f572-fe03-58fc-b61c-816925466a97&amp;function=cover&amp;type=preview&amp;source=false&amp;width=2000\" width=\"1178\" height=\"858\" alt=\"Bree Wilkerson, 25, of Farmington, was shot and killed May 7 by U.S. Marshals near the intersection of Hubbard Road and Copper Avenue.\" class=\"naviga-image\" loading=\"lazy\"><figcaption><span class=\"caption\">Bree Wilkerson, 25, of Farmington, was shot and killed May 7 by U.S. Marshals near the intersection of Hubbard Road and Copper Avenue.<\/span><span class=\"credit\">cca<\/span><\/figcaption><\/figure>\n<\/p><p>Wilkerson, 25, was driving a Chevrolet Blazer near Hubbard Road and Copper Avenue when U.S. marshals opened fire on the vehicle, striking her four times, according to an autopsy obtained from the Office of the Medical Investigator in Albuquerque.<\/p>\n<p>Roe, 37, was a passenger in the Blazer. He was wanted on local warrants for failure to appear and failure to comply with fourth-degree felony charges, according to a report from the San Juan County Sheriff\u2019s Office. He also was shot and killed, but his autopsy has not been released.<\/p>\n<p>On July 31, the <em id=\"emphasis-5c97dd8b68a8577f98f2c9e98de46297\">Tri-City Record <\/em>submitted an Inspection of Public Records Act request for Roe\u2019s autopsy. On Aug. 15, the Office of the Medical Investigator responded, stating \u201cno responsive records located for request.\u201d A second request was submitted Sept. 8.<\/p>\n<p>At least three deputies from the U.S. Marshals Service were involved in the shooting. They were identified in a San Juan County Sheriff\u2019s Office summary as Jared Santesson, Mike Coconis and Navid Babadi.<\/p>\n<div class=\"naviga-element naviga-x-im-unordered-list\">The marshal believed to be Babadi said he fired his weapon at least four times.<\/div>\n<div class=\"naviga-element naviga-x-im-unordered-list\">The marshal believed to be Coconis said he fired his weapon twice.<\/div>\n<div class=\"naviga-element naviga-x-im-unordered-list\">The marshal believed to be Santesson said he fired his weapon four times.<\/div>\n<p>On Sept. 8, the<em id=\"emphasis-6ef186a083409ecb1d25ac6eab2bd382\"> Tri-City Record<\/em> made an Inspection of Public Records Act request to the San Juan County Sheriff\u2019s Office seeking the crime scene report and evidence list to confirm reports from an outside source that more than 20 shots were fired. This is double what the marshals claimed to have fired.<\/p>\n<p>The San Juan County Sheriff\u2019s Office stated, \u201cWe need additional time to search for, collect, and process any responsive records,\u201d adding that a response would be made available by Sept. 23.<\/p>\n<p>According to Curnutt, the shooting conflicts with not only the U.S. Marshals Services\u2019 use-of-force policy, but also with the May 15 decision by the U.S. Supreme Court in the case of Barnes v. Felix.<\/p>\n<p>\u201cThat\u2019s a huge case for us,\u201d Curnutt said, adding it \u201cstates that courts must now analyze the totality of the circumstances to consider all the events and factors that lead up to the incident that we now claim is an excessive force problem.\u201d<\/p>\n<p>Curnutt said, \u201cIf those are the rules, they don\u2019t comply with their own policy.\u201d<\/p>\n<p>Specifically, U.S. Marshals Services policy justifies the use of deadly force when the officer has a \u201creasonable belief that the subject of such force poses an imminent danger of death or serious physical injury to the officer or to another person.\u201d<\/p>\n<p>It also states that deadly force \u201cmay not be used solely to prevent the escape of a fleeing suspect.\u201d<\/p>\n<p>Witnesses stated that Wilkerson was driving away from the scene when she and Roe were fatally shot.<\/p>\n<p>Marshals said they were in fear for their lives and safety and that the vehicle was driving toward them.<\/p>\n<p>\u201cThey attempt to exaggerate their own defense, but fortunately we have a court ruling,\u201d Curnutt said.<\/p>\n<p>The marshals involved also claimed there were prior reports of Roe having both a handgun and an AK-47.<\/p>\n<p>Marshals stated that Farmington police saw an AK-47 in a black Mercury tied to Roe.<\/p>\n<p><figure class=\"wp-block-image naviga-inline-image\"><img decoding=\"async\" src=\"https:\/\/imengine.public.prod.dur.navigacloud.com\/?uuid=5657a237-62e0-596d-8aed-31a2d3f56e75&amp;function=cover&amp;type=preview&amp;source=false&amp;width=2000\" width=\"1668\" height=\"862\" alt=\"Breanna Wilkerson, 25, questioned by Farmington Police Sgt. Carlos Martinez and Breanna Wilkerson outside a home on Copper Avenue.<\/p>\n<p>Martinez, a cross-deputized U.S. marshal, was investigating a reportedly stolen Mercury parked in a driveway.<\/p>\n<p>\u201cThere\u2019s a rifle in the vehicle he was working on,\u201d Martinez said in the video, after someone on the police radio said the individual reportedly seen running away \u201cgoes by BB.\u201d<\/p>\n<p>Unconfirmed reports suggest Roe\u2019s nickname was \u201cBB.\u201d<\/p>\n<p>In the video, Martinez questioned Wilkerson, who did not confirm the vehicle belonged to \u201cBB.\u201d He also questioned the homeowner, who said \u201cBB\u201d ran inside the house but could not provide a confirmed identity.<\/p>\n<p>Police did not obtain a warrant and did not search the vehicle or the home. They left the scene. The interaction occurred three weeks before the deadly shooting.<\/p>\n<p>On July 31, the <em id=\"emphasis-a46ced0c8d8d4a54a6cb387d01d58d11\">Tri-City Record<\/em> requested copies of post-shooting recorded interviews with San Juan County Sheriff\u2019s deputies who were on scene. At least seven were present, according to a document provided through a public records request.<\/p>\n<p>San Juan County Sheriff\u2019s Capt. Kevin Burns stated: \u201cDet. Courtney was the lead investigator and was not interviewed as an involved or witness. Det. Chandler responded in a call-out capacity to assist with the investigation. Conversations with investigators outside the context of involvement in the incident are not recorded so this record does not exist.\u201d<\/p>\n<p>In an interview with the <em id=\"emphasis-f4928537b270f4fe495059764cf51d65\">Tri-City Record,<\/em> attorney Jason Bowles said obtaining records and information has been difficult.<\/p>\n<p>\u201cWe\u2019ve, frankly, run into some roadblocks with the agency sharing information in a timely fashion,\u201d Bowles said, adding that his office is \u201cjust now trying to uncover the full truth, and that\u2019s what our efforts are directed at now.\u201d<\/p>\n<p>Obtaining accurate information for a lawsuit is critical, said attorney Mark Curnutt.<\/p>\n<p>\u201cCase law now says if you misdate a claim or you make some error as to who you are identifying you could be barred from seeking the claim.
