Last week, Fortner referred it to the New Mexico Administrative Offices of the District Attorney for evaluation.<\/p>\n<p>\u201cThey can make the recommendation,\u201d Chief Deputy District Attorney Brian Decker said.<\/p>\n<p>Three deputies from the U.S. Marshals Service were involved in the shooting. They were identified in a San Juan County Sheriff\u2019s Office summary as Jared Santesson, Mike Coconis and Navid Babadi.<\/p>\n<p><figure class=\"wp-block-image naviga-inline-image naviga-align-left alignleft\"><img decoding=\"async\" src=\"https:\/\/imengine.public.prod.dur.navigacloud.com\/?uuid=1f21cca6-169a-5ba0-a0f1-230e54effdcf&amp;function=cover&amp;type=preview&amp;source=false&amp;width=2000\" width=\"640\" height=\"653\" alt=\"Brandon Roe\" class=\"naviga-image\" loading=\"lazy\"><figcaption><span class=\"caption\">Brandon Roe<\/span><span class=\"credit\">cca<\/span><\/figcaption><\/figure>\n<figure class=\"wp-block-image naviga-inline-image\"><img decoding=\"async\" src=\"https:\/\/imengine.public.prod.dur.navigacloud.com\/?uuid=61b9f572-fe03-58fc-b61c-816925466a97&amp;function=cover&amp;type=preview&amp;source=false&amp;width=2000\" width=\"1178\" height=\"858\" alt=\"Bree Wilkerson, 25, of Farmington, was shot and killed May 7 by U.S. Marshals near the intersection of Hubbard Road and Copper Avenue.\" class=\"naviga-image\" loading=\"lazy\"><figcaption><span class=\"caption\">Bree Wilkerson, 25, of Farmington, was shot and killed May 7 by U.S. Marshals near the intersection of Hubbard Road and Copper Avenue.<\/span><span class=\"credit\">cca<\/span><\/figcaption><\/figure>\n<\/p><p>In separate statements, the deputies admitted to shooting and killing Breanna \u201cBree\u201d Wilkerson, 25, a puppy, and Brandon Roe, 37, on May 7 while attempting to serve local warrants to Roe, who was wanted for failure to appear and failure to comply on fourth-degree felony charges.<\/p>\n<p>The Office of the Medical Investigator at the University of New Mexico ruled both deaths homicides.<\/p>\n<p>Wilkerson was driving a gold Chevrolet Blazer with Roe as her passenger when the marshals opened fire. She was shot four times, according to the autopsy. Roe was shot eight times, including wounds to the head, face and neck, three to his right shoulder, and two to his right chest.<\/p>\n<p>The marshals stated that no more than 10 shots were fired. Babadi said he fired at least four times, Coconis said he fired twice, and Santesson said he fired four times.<\/p>\n<p>However, autopsies confirmed that at least 12 bullets struck Wilkerson and Roe.<\/p>\n<p>On Sept. 8, the <em id=\"emphasis-32afc662a3990fd912393fb31047e7b8\">Tri-City Record <\/em>filed an Inspection of Public Records Act request with the San Juan County Sheriff\u2019s Office seeking the crime scene report and evidence list to confirm reports from an outside source that more than 20 shots were fired\u2014double what the marshals claimed.<\/p>\n<p>Roe\u2019s autopsy noted \u201cmultiple gunshot wounds, some of which are surrounded by pseudo-stippling, consistent with being shot through an intermediary target (window, car door, etc.).\u201d<\/p>\n<p>The range of fire was listed as \u201cindeterminate.\u201d Roe suffered fatal injuries to the skull, brain and right lung, with blood accumulation in the right chest cavity, among other injuries.<\/p>\n<p>His time of death was listed as 10:10 p.m., nearly four hours after the shooting, which occurred around 6:30 p.m. near Hubbard Road and Copper Avenue.<\/p>\n<p>Now that the case has been turned over to the New Mexico Administrative Offices of the District Attorney, two attorneys will review it: former San Juan County District Attorney Rick Tedrow, now director of the administrative offices, and Special Counsel Marco Serna.<\/p>\n<p>Tedrow said he and Serna will review the case individually and then \u201cmake a recommendation on whether there should be charges.\u201d<\/p>\n<p>Once complete, the case will be returned to San Juan County District Attorney Fortner.<\/p>\n<p>\u201cIt will be his decision on how he wants to proceed,\u201d Tedrow said, adding that Fortner could determine there is a conflict of interest.
