(Josh Stephenson\/Special to the Herald)<\/span><span class=\"credit\">cca<\/span><\/figcaption><\/figure>\n<\/p><p>A 15-year-old boy and his father were \u201cbeaten, handcuffed and forced to sign documents\u201d after being arrested Monday in Durango by federal immigration officers, the boy\u2019s mother told an immigrant services nonprofit.<\/p>\n<p>Estela Pati\u00f1o said she spoke with her son, Kewin Daniel Pati\u00f1o Bustamante, in a phone call shortly after 10 p.m. Monday \u2013 the last time she has heard from him as of Wednesday morning, according to Compa\u00f1eros: Four Corners Immigrant Resource Center.<\/p>\n<p>She said she has not spoken with her 12-year-old daughter, Jana Michel Jaramillo Pati\u00f1o, since the arrest.<\/p>\n<p>In an open letter to Sens. Michael Bennet and John Hickenlooper, Compa\u00f1eros identified the father as Fernando Jaramillo Solano.<\/p>\n<p>Durango Police Department officers attempted a welfare check on Kewin after receiving a report of possible abuse by federal agents but were denied entry to the U.S. Immigration and Customs Enforcement field office on Tuesday, the city said in a news release.<\/p>\n<p>Compa\u00f1eros expressed concern that Jana was being held in the custody of only men, calling it \u201cnot just terrible\u201d but \u201cinhumane\u201d and a violation of \u201cevery prevailing human right for children.\u201d<\/p>\n<p>\u201c\u200bThese children are just children; they bear NO responsibility of any kind,\u201d Compa\u00f1eros said in a Facebook post.<\/p>\n<p>The group described Solano as an \u201chonest and hardworking individual\u201d who works more than 80 hours a week at two cleaning companies and a hotel.<\/p>\n<p>Solano has no criminal record, nor do his wife or children, and the family is seeking asylum in the United States, according to Compa\u00f1eros.<\/p>\n<p>The family, originally from Colombia, has lived and worked in Colorado for more than 18 months, and their asylum case remains open and active, according to Compa\u00f1eros.<\/p>\n<div class=\"naviga-element naviga-subheadline1\">\u2018It\u2019s destroyed her life\u2019<\/div>\n<p><figure class=\"wp-block-image naviga-inline-image\"><img decoding=\"async\" src=\"https:\/\/imengine.public.prod.dur.navigacloud.com\/?uuid=00e7f6e4-8347-5b46-beec-ce0db1022ff2&amp;function=cover&amp;type=preview&amp;source=false&amp;width=2000\" width=\"2000\" height=\"1333\" alt=\"Immigration advocates were turned away from the U.S. Immigration and Customs Enforcement office Tuesday in Durango after two children arrested Monday morning had been held there for more than 24 hours. (Christian Burney\/Durango Herald)<\/span><span class=\"credit\">cca<\/span><\/figcaption><\/figure>\n<\/p><p>In an interview Wednesday with <em id=\"emphasis-219c3ccb2b3a87d0c4d7eb348a664073\">The Durango Herald<\/em>, Pati\u00f1o said she feels like she is \u201cdrowning\u201d and \u201cchoking.\u201d She said the arrests by immigration agents felt like an attack on her entire experience in the United States.<\/p>\n<p>She spoke in Spanish, with Liza Tregillus of the Apoyo Immigrant Partner Team providing English translation.<\/p>\n<p>\u201cIt\u2019s destroyed her life,\u201d Tregillus said of the arrests.<\/p>\n<p>Pati\u00f1o said her family came to the U.S. seeking protection. In Colombia, she said, they lived under threat of being killed. Now, she feels the same persecution \u2013 this time with her children as targets.<\/p>\n<p>Pati\u00f1o began to cry.<\/p>\n<p>\u201cIt\u2019s reminding me of the worst year I spent in Colombia,\u201d she said. \u201cI feel attacked. Their arrest sparked a protest lasting more than 24 hours.<\/p>\n<p>By noon Tuesday, more than 200 people had gathered outside the field office\u2019s barbed-wire fence.<\/p>\n<p>Protest signs read \u201cResist fascism,\u201d \u201cYou\u2019re the bad guys, go away ICE,\u201d and \u201cLet them out!\u201d<\/p>\n<p>Protesters chanted \u201cFree the kids \u2013 and the dad,\u201d strummed guitars, pounded drums and sang.<\/p>\n<figure class=\"wp-block-embed is-type-video wp-block-embed-youtube naviga-video-embed\">\n<div class=\"wp-block-embed__wrapper\"><iframe loading=\"lazy\" width=\"560\" height=\"315\" src=\"https:\/\/www.youtube.com\/embed\/eEo26BY5ATE\" frameborder=\"0\" allow=\"accelerometer; autoplay; clipboard-write; encrypted-media; gyroscope; picture-in-picture\" allowfullscreen><\/iframe><\/div>\n<\/figure>\n<p>Protesters \u2013 ranging from teens to white-haired adults \u2013 formed a human chain at two entrances to the field office Monday night at 32 Sheppard Drive. Volunteers donated food, coffee and blankets as protesters hunkered down for a cold night.<\/p>\n<p>Many protesters wore masks. Some blew whistles just before daybreak Tuesday as a vehicle arrived to deliver food to the family.<\/p>\n<p>ICE agents exited the building, and a confrontation ensued.<\/p>\n<p>Tensions escalated around noon Tuesday, when federal agents used <a href=\"https:\/\/www.durangoherald.com\/articles\/confrontation-escalates-between-protesters-federal-agents-in-durango\/\" id=\"link-02612f3dbdcd1bc0319fec27985e57b4\" target=\"_blank\">pepper spray and rubber bullets<\/a> to clear protesters from the gates.<\/p>\n<p>Once the gates were cleared, several black vans \u2013 thought to be carrying Kewin and Jana \u2013 left the facility. Once the vans left, the crowd dispersed, believing the children had been taken away.<\/p>\n<p>But Tregillus said a Colorado Rapid Response Network confirmer saw a white van enter the facility and later leave with all three family members after the protesters had gone.<\/p>\n<p>Beatriz Garcia Waddell, Western Slope organizer for the Colorado Immigrant Rights Coalition, confirmed the same story.<\/p>\n<p>On Monday, Compa\u00f1eros said the children believed they would be separated from their father \u2013 sent to Texas while he would go elsewhere.<\/p>\n<p>But Tregillus said she and Pati\u00f1o called the South Texas Family Residential Center in Dilley, Texas, on Wednesday morning and learned all three were being taken there together.<\/p>\n<p>\u201cThat is a huge relief,\u201d Tregillus said, adding that it remains unfair.<\/p>\n<p>She said ICE agents falsely claimed that if Pati\u00f1o had a legal representative and an active asylum case, her partner and children would be released. But that didn\u2019t happen.<\/p>\n<p>Pati\u00f1o attended the protest and watched from the sidelines, hoping demonstrators could stop agents from taking her children, Tregillus said.<\/p>\n<p>As the vans passed, she collapsed and wailed in despair.<\/p>\n<p>\u201cIt\u2019s destroyed her life,\u201d Tregillus said. \u201cI have never been present with such awful grief in my life as when she saw them.\u201d<\/p>\n<p>Apoyo is providing Pati\u00f1o with safe places to stay while an attorney, funded by the group, assesses the family\u2019s case, Tregillus said. But Tregillus said Pati\u00f1o feels unsafe despite having a strong asylum case.<\/p>\n<p>Pati\u00f1o is now requesting her husband and children to be allowed to self-deport to Colombia. But in all likelihood, they will be stuck in detention for months given a backlog of cases.<\/p>\n<p>\u201cBad news: Once you\u2019re detained, even if you want to self-deport, it can be weeks or even months,\u201d Tregillus said. \u201cSometimes the family must go back to court and ask for a removal order.\u201d<\/p>\n<p>Bonds are not being issued for detainees awaiting court dates, she said.<\/p>\n<p>\u201cMany get sent back anyway,\u201d she said. \u201cBut having to wait in a detention center is not a choice this family wants to accept.\u201d<\/p>\n<p>She said more than 25 local children have lost a parent to ICE removals.<\/p>\n<p>\u201cIt is completely, just beyond \u2026\u201d Tregillus said, at a loss for words. \u201cTo call this a solution to any immigration problem \u2026 We are punishing people who did not design the system, that does not help them get an answer as to whether they can legally be here or not.\u201d<\/p>\n<p>Drawing on her experience as a play therapist, she said removing a child\u2019s parents is one of the most damaging things someone can do to a young child\u2019s mental health.<\/p>\n<div class=\"naviga-element naviga-subheadline1\">ICE responds<\/div>\n<p><figure class=\"wp-block-image naviga-inline-image\"><img decoding=\"async\" src=\"https:\/\/imengine.public.prod.dur.navigacloud.com\/?uuid=3dfd586e-08ab-5a10-af4e-0a2cd143e367&amp;function=cover&amp;type=preview&amp;source=false&amp;width=2000\" width=\"2000\" height=\"1451\" alt=\"Agents cut cable locks put there by protesters who wanted to prevent vehicles from leaving a U.S. Immigration and Customs Enforcement field office Tuesday in Durango. (Josh Stephenson\/Special to the Herald)<\/span><span class=\"credit\">cca<\/span><\/figcaption><\/figure>\n<\/p><p>In response to Tuesday\u2019s protest, ICE questioned demonstrators\u2019 motives, touted the arrests of three \u201ccriminal aliens\u201d unrelated to the Pati\u00f1o-Solano family, and repeated a <a href=\"https:\/\/www.cpr.org\/2025\/10\/02\/ice-agent-assault-claims-data-lacking\/\" id=\"link-7453bf4b4000e3375fcd35637df269c0\" target=\"_blank\" rel=\"noopener\">disputed claim<\/a> from U.S. Attorney General Pam Bondi that assaults on ICE agents have risen by 1,000%.<\/p>\n<div class=\"naviga-scoreboard\">\n<h4 class=\"scoreboard-title\">ICE detains three with criminal backgrounds in Durango area<\/h4>\n<p>A U.S. Immigration and Customs Enforcement spokesperson named three people with criminal backgrounds it arrested in the Durango area, as follows:Juan Lorenzana-Ruvalcaba, 41, of Mexico. He was arrested for criminal penetration of a child and aggravated battery, and prosecution is pending for felony manufacturing, distributing or dispersing of a controlled substance. Anderson Tovar-Perez, 29, of Venezuela. Tovar-Perez was convicted of child abuse and driving while intoxicated. Daniel Rivera-Munoz, 36, of Mexico. He was convicted of \u201cillegal alien possession of a firearm\u201d and has been arrested for aggravated assault with a deadly weapon and felony possession of a controlled substance.<\/p>\n<\/div>\n<p>\u201cWhat these protestors (sic) hope to achieve by chaining the gates of a federally leased property is unclear,\u201d the spokesperson said. \u201cTheir actions do nothing to serve the detainees they claim to support or the community, instead delaying lawful processes and creating unnecessary risks for everyone involved.\u201d<\/p>\n<p>ICE said in a statement that it respects First Amendment rights to peaceful protest but added that extreme protesters often misrepresent the agency\u2019s mission.<\/p>\n<p>\u201cCalls to abolish ICE or obstruct its operations inadvertently support the release of dangerous individuals with no legal right to remain in the U.S., including those convicted of violent crimes, drug trafficking, child exploitation, and other serious offenses,\u201d the spokesperson said.<\/p>\n<p>ICE described Solano as \u201can illegal alien from Colombia\u201d who entered the U.S. on Dec. 22, 2024, near San Diego.<\/p>\n<p>Asked why Solano and his children \u2013 who have an open asylum case and no criminal records \u2013 were arrested, the spokesperson said ICE \u201ccannot comment on an individual\u2019s asylum claims\u201d and noted that a pending asylum claim does not prevent arrest or removal.<\/p>\n<p>The spokesperson did not answer questions about its policies for interacting with protesters and instead referred the <em id=\"emphasis-6999fef3ffe07508cc02709c51e85ffe\">Herald <\/em>to another ICE media contact. That media contact did not respond to inquiries about policies for engaging protesters or standards of care for minors in its custody.<\/p>\n<p>\u201cICE takes any allegations regarding professional misconduct seriously,\u201d the spokesperson said when asked about alleged abuse of Solano and his son.<\/p>\n<p>The ICE Office of Professional Responsibility investigates and takes action where warranted, the spokesperson said.<\/p>\n<p>Tregillus said ICE is targeting people with asylum cases less than two years old, even if they have no criminal history. She said active asylum cases should not make someone eligible for deportation \u2013 and didn\u2019t under President Joe Biden.<\/p>\n<p>But she said the Trump administration is changing the rules, putting current asylees at risk of removal.<\/p>\n<p>She suspects President Donald Trump is under pressure to fill detention center beds to justify their existence.<\/p>\n<p>\u201cThere was no court order signed by a judge to detain him (Solano). So that\u2019s illegal,\u201d Tregillus said. \u201cTo detain the children as well is over-the-top.
