(Photos by Evan Agostini\/Invision\/AP)<\/span><span class=\"credit\">(Photos by Evan Agostini\/Invision\/AP)<\/span><\/figcaption><\/figure>\n<p>NEW YORK (AP) \u2014 The legal battle between actors Blake Lively and Justin Baldoni hit center stage in a New York federal courtroom again Monday despite a <a href=\"https:\/\/apnews.com\/article\/blake-lively-justin-baldoni-lawsuit-settlement-487a0a823349c95c502aa35b3752357b\" target=\"_blank\" rel=\"noopener\">recent deal to end Lively&#8217;s claims<\/a> that she suffered retaliation after making sexual harassment claims over the making of their 2024 film \u201cIt Ends With Us.\u201d<\/p>\n<p>Attorney Ellyn Garofalo, representing Baldoni, told U.S. District Judge Lewis J. Liman that Lively was trying through an application for attorney fees to do \u201can end run around the jury trial\u201d that was voided when a deal was reached before a May trial was set to start.<\/p>\n<p>At a hearing without the actors, Garofalo told Liman it was wrong for Lively to seek damages and attorneys fees after agreeing to a settlement in which she dismissed her claims without Baldoni and his production company \u201cpaying a cent of the $300 million in damages she was demanding.\u201d<\/p>\n<p>\u201cReopening this for basically what is an alternative trial would involve reopening discovery, new experts, new expert depositions,\u201d she said. Garofalo called it \u201ceffectively an end run around the jury trial.\u201d<\/p>\n<p>A California law permits \u201csignificant\u201d penalties to be levied against any party who filed unsuccessful retaliatory defamation actions against sexual harassment and retaliation litigants. Baldoni&#8217;s countersuit alleging defamation and extortion was tossed out last year by the judge.<\/p>\n<p>Liman did not immediately rule after hearing more than an hour of arguments.<\/p>\n<p>Attorney Michael Gottlieb, representing Lively, asserts that the lawsuit Baldoni brought against Lively was the very kind of litigation the California law was designed to stop, enabling survivors of sexual harassment to be protected from a protracted and damaging legal fight.<\/p>\n<p>In early May, Lively and Baldoni <a href=\"https:\/\/apnews.com\/article\/blake-lively-justin-baldoni-lawsuit-settlement-37c40e22e67d47ccf33357770c114af7\" target=\"_blank\" rel=\"noopener\">agreed to settle a lawsuit<\/a> that had left both sides publicly making claims against one another since the litigation began in December 2024 when Lively, 38, sued Baldoni, 42, and his production company, Wayfarer Studios.<\/p>\n<p>Weeks after Lively filed suit, Baldoni sued Lively, accusing her, her husband \u2014 \u201cDeadpool\u201d actor Ryan Reynolds \u2014 and their publicist of defamation and extortion.<\/p>\n<p>Baldoni, who directed the dark romantic drama and starred in it with Lively, denied harassing her or orchestrating a smear campaign. He claimed the complaints about his behavior were made up by Lively as part of an effort to seize creative control of the movie.<\/p>\n<p>The settlement was reached days after Liman dismissed Lively\u2019s sexual harassment claims, ruling that she couldn\u2019t pursue them under federal law because she was an independent contractor rather than an employee on the movie set.<\/p>\n<p>Lively had claimed that during filming, Baldoni made inappropriate comments about her appearance, violated physical boundaries while filming a love scene, and pushed for nudity \u2014 against Lively\u2019s wishes \u2014 during a scene in which her character was giving birth.<\/p>\n<p>Baldoni denied doing anything outside of what occurs during the normal creative process to make a movie.<\/p>\n<p>In their joint statement after the deal was reached, the parties said they recognize that Lively\u2019s concerns \u201cdeserved to be heard\u201d and that they \u201dremain firmly committed to workplaces free of improprieties and unproductive environments.\u201d<\/p>\n<p>\u201cIt Ends With Us,\u201d an adaptation of <a href=\"https:\/\/apnews.com\/article\/lifestyle-entertainment-business-arts-and-entertainment-fiction-fbed44e32e3797b7c3fdbf0a4a7daead\" target=\"_blank\" rel=\"noopener\">Colleen Hoover\u2019s bestselling 2016 novel<\/a> about a relationship devolving into domestic violence, was released in August 2024 and <a href=\"https:\/\/apnews.com\/article\/blake-lively-ryan-reynolds-box-office-ends-with-us-deadpool-b5d25319d02489aa1c3b7bf2a786e5d7\" target=\"_blank\" rel=\"noopener\">exceeded box office expectations<\/a> despite <a href=\"https:\/\/apnews.com\/video\/justin-baldoni-movies-violence-blake-lively-05fd10c7138541ce9d62a521614f73a2\" target=\"_blank\" rel=\"noopener\">criticism that it glorified abuse<\/a>.<\/p>\n<p>Lively appeared in the 2005 film \u201cThe Sisterhood of the Traveling Pants\u201d and the TV series \u201cGossip Girl\u201d from 2007 to 2012 before starring in films including \u201cThe Town\u201d and \u201cThe Shallows.\u201d<\/p>\n<p>Baldoni starred in the TV comedy <a href=\"https:\/\/apnews.com\/television-general-news-national-national-f2a5f10de13c4679911e388fd8bd5e9d\" target=\"_blank\" rel=\"noopener\">\u201cJane the Virgin,\u201d<\/a> directed the 2019 film \u201cFive Feet Apart\u201d and wrote \u201cMan Enough,\u201d a book challenging traditional notions of masculinity.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Lively appears at the SNL50: The Anniversary Special at Rockefeller Plaza in New York on Feb. 16, 2025, left, and Justin Baldoni appears at a special screening of &quot;The Boys in the Boat&quot; in New York on Dec. 13, 2023.
