District Court Judge Todd Plewe on Friday, Nov. 8, granted a motion by Maximilian Investors to discharge Jaeger Kottmeier Associates, the court appointed receiver of the mine. The order didn\u2019t clear the receiver of all civil claims from Boyd Sanders, owner of property leased to and polluted by Red Arrow owner Craig Luikko.<\/p>\n
\u201cMy client has two major concerns,\u201d said John Kelly, Sanders\u2019 attorney. \u201cWe want to regain control of the property pending EPA remediation, and we want to be able to seek damages against Red Arrow.\u201d<\/p>\n
Plewe agreed to leave Kelly and his clients legal wiggle room to seek damages from the receiver under the premise of willful misconduct or gross negligence.<\/p>\n
\u201cThere\u2019s been nothing shown that the receiver has demonstrated gross negligence,\u201d said Donald Allen, attorney for Jaeger Kottmeier Associates. \u201cThe receiver is entitled to a discharge of all claims.\u201d<\/p>\n
Allen told Plewe on Friday that the receiver is not liable because Sanders rented his property to Luikko.<\/p>\n
Neither Luikko nor his attorney was present at the half-hour proceedings.<\/p>\n
After granting the motion, Plewe stayed all matters in two separate civil cases filed by Maximilian Investors against Heman LLC and American Patriot Gold LLC, citing pending bankruptcy proceedings in Texas.<\/p>\n
Plewe ordered the Red Arrow Gold Mine into receivership in April.<\/p>\n
