The Gem Village man charged along with his teenage son of robbing a Durango medical marijuana outlet waived his right to a preliminary hearing Thursday, which determines if there is probable cause to proceed to trial.<\/p>\n
Instead, Joe Griffith will return May 7 before Judge Jeffrey Wilson in 6th Judicial District Court with an answer to an offer from the district attorney.<\/p>\n
Deputy District Attorney Reid Stewart declined to say what the state has offered Griffith. Griffith was charged with one count of aggravated robbery of a controlled substance, one count of aggravated robbery and two counts of attempted aggravated robbery.<\/p>\n
Griffith, who is being held on $100,000 bail, and son Logan, 19, are suspected of robbing the Rocky Mountain High Dispensary on Jan. 31. Logan Griffith posed as a customer and was tied up along with two dispensary employees by his son, according to police. The younger Griffith, clad in a dark-colored hoodie and ski mask, allegedly was armed with a loaded handgun.<\/p>\n
Logan Griffith, who allegedly made off with $3,000 and a significant amount of marijuana, was taken into custody by police less than one mile away within an hour.<\/p>\n
Logan, who waived a preliminary hearing earlier this month, also is considering an offer from the district attorney that could place him in the Youthful Offender System instead of state prison.<\/p>\n
Logan, sporting a shaved head in place of a shaggy mane, appeared before Judge Wilson on Thursday for arraignment, but the hearing was continued to May 7.<\/p>\n
He initially was charged with two counts of felony robbery, including one for using a firearm and another for taking a controlled substance.<\/p>\n
