DENVER \u2013 Gov. John Hickenlooper on Tuesday defended his proposal to restructure a hospital fee to balance the state budget.<\/p>\n

Hickenlooper\u2019s comments came after Republicans raised concerns with the governor\u2019s plan ahead of the legislative session, which begins Wednesday.<\/p>\n

The governor\u2019s proposal \u2013 his leading agenda item for the upcoming session \u2013 would restructure the fee paid to hospitals to exempt it from the Taxpayer\u2019s Bill of Rights.<\/p>\n

The fee counts as revenue subject to taxpayer refunds. It was established to force larger contributions by the federal government to compensate health care costs.<\/p>\n

\u201cI don\u2019t think anyone anticipated how rapidly the state\u2019s economy would bounce back,\u201d Hickenlooper, a Democrat, told reporters on Tuesday.<\/p>\n

The governor\u2019s proposal calls for turning the hospital provider fund into an enterprise fund, or government-owned business. The move would take the revenue out of the TABOR calculation and lower refunds set aside in the general fund, thereby freeing up the general fund for spending.<\/p>\n

Hickenlooper\u2019s budget writers have proposed $373 million in balancing measures.<\/p>\n

Republicans last week pointed to a legal memo from nonpartisan legislative counsel, which stated that the fee restructuring would violate the state constitution.<\/p>\n

Much of the opinion revolves around whether the state could successfully restructure the fund as an enterprise. The nonbinding memo states that lawmakers must ask voters for permission or enact legislation allowing the Legislature to create a new TABOR-exempt enterprise.<\/p>\n

Republicans, who control the Senate, have led attacks against the governor and other Democrats who support the proposal. The GOP has suggested that Democrats ignored legal guidances when the same issue came up during the legislative session last year.<\/p>\n

\u201cTo disregard this red flag is reckless in the extreme,\u201d said Senate President Bill Cadman of Colorado Springs.<\/p>\n

But the governor believes the legal opinion missed key facts. His office is seeking an official written opinion from Republican Attorney General Cynthia Coffman, whose office previously gave verbal approval, according to Hickenlooper.<\/p>\n

\u201cOur hope is that when we go back to the legislative legal affairs office and say, \u2018here\u2019s some other facts you didn\u2019t know,\u2019 they might reconsider,\u201d the governor said, adding that he is confident that the fund fits the enterprise definition.<\/p>\n

Republicans counter that the governor should instead be focused on cutting spending, pointing to rising Medicaid costs. But Hickenlooper pointed out that Medicaid expansions have covered many children.<\/p>\n

\u201cIt\u2019s hard for me to justify taking hospital care away from kids. It\u2019s not their fault that they\u2019re in a family that doesn\u2019t have the resources,\u201d Hickenlooper said.<\/p>\n

Drawing upon his background as a geologist, Hickenlooper underscored that the hospital-provider fee proposal is only one \u201chypothesis,\u201d or possible solution.<\/p>\n

\u201cWe\u2019re going to have to be looking at the budget and say, \u2018well, we might have the hospital-provider fee, and we might not \u2026\u201d the governor added. \u201cIt\u2019s the second hypothesis that we might have it, and we have to be discussing what our priorities are if that is in fact the case.\u201d<\/p>\n

Wedding, Broncos on Hickenlooper\u2019s mind<\/h4>\n

DENVER \u2013 Gov. John Hickenlooper on Tuesday diverged from discussions on the business of the Legislature to talk about his upcoming wedding and the Denver Broncos playoffs hopes.
\n On Saturday \u2013 a day before the Broncos face off against the Pittsburgh Steelers \u2013 Hickenlooper is expected to marry his fianc\u00e9e, Robin Pringle.
\n The pair was engaged over the Christmas holiday, after dating for a little over a year. Hickenlooper popped the question at his Denver home.
\n \u201cI just manned up,\u201d Hickenlooper joked, a smile across his face, as he addressed a pack of journalists fishing for the gossip.
\n \u201cI\u2019ve been trying to talk her out of it for months,\u201d he continued. \u201cShe still seemed eager, so I just looked her in the eye and said, \u2018Should we do this? Would you be willing to get married and be my wife?\u2019\u201d
\n The wedding is expected to be a small private affair.
\n Pringle, 37, is a vice president of corporate development at Liberty Media in Douglas County. This is the second marriage for the 63-year-old Hickenlooper, who separated from Helen Thorpe in July 2012 after 10 years of marriage.
\n The proposal wasn\u2019t the only recent courageous move for the governor. He also on Tuesday backed Peyton Manning over Brock Osweiler to lead the Broncos against the Steelers in the divisional round of the playoffs at home on Sunday.
\n \u201cThe first thing to realize is that the Broncos have established, once again, that they are a team blessed \u2026\u201d Hickenlooper said. \u201cGiven that there seems to be some level of intervention \u2026 that would lead me to support Peyton Manning. He has had one of the most blessed careers.\u201d
