U.S. Rep. Scott Tipton gave an update on his legislative efforts affecting Colorado\u2019s 3rd Congressional District during the Southwest Colorado Livestock Association meeting last week.<\/p>\n

Tipton, a Republican from Cortez, represents the largest district in Colorado, totaling 29 counties including the entire Western Slope. It is the eighth-largest Congressional district in the nation.<\/p>\n

During a half-hour speech to agricultural constituents at the Elks club, he denounced \u201cregulatory overreach\u201d by the federal government on matters of water and public lands.<\/p>\n

Tipton and other Republicans have been fighting the EPA\u2019s proposed Waters of the United States (WOTUS) rule, saying it puts private water rights at risk.<\/p>\n

\u201cThe conditional permit (of the rule) impacts farm and ranch and ski areas because it requires you to sign over your water rights to the federal government if you want to get a lease renewed,\u201d he said. \u201cWe call that theft.\u201d<\/p>\n

Opponents of the WOTUS rule say it expands federal jurisdiction of water rights under the Clean Water Act. After Colorado and 12 other states objected to the rule, the U.S. Court of Appeals for the 6th Circuit put the rule\u2019s implementation on hold.<\/p>\n

Under the Congressional Review Act, the House and Senate passed a resolution to disapprove the WOTUS rule, but it was vetoed by President Barack Obama.<\/p>\n

Tipton said his Water Rights Protection Act bill would provide a way to challenge the federal government on seizing water rights without just compensation in exchange for land-use permits. The bill has passed the House, and has a hearing on the Senate side.<\/p>\n

A directive out of the U.S. Forest Service to regulate groundwater is also a big concern, he said.<\/p>\n

\u201cAs far as the Forest Service groundwater regulation, they backed off on the rule, but there in lies the problem, the bureaucracy could move it forward at a later time. They will try an wait you out,\u201d Tipton said.<\/p>\n

Federal regulatory directives such as the EPA\u2019s WOTUS and the Clean Power Plan are taking over the legislative system, Tipton said.<\/p>\n

\u201cWe have seen the power of legislative bodies eroded by rule and regulations,\u201d he said. \u201cFrankly it is Congress\u2019s fault, they yielded back authority to the executive branch and it must be reclaimed.\u201d<\/p>\n

His office is refocusing attention to Article 1 of the Constitution that identifies the role of Congress to pass legislation.<\/p>\n

\u201cOnce a rule or regulation goes final it takes the proverbial Act of Congress to rescind it,\u201d Tipton lamented. \u201cYet the regulation was never voted on by any Republican or Democrat in the House or Senate, and that is not the way the Constitution intended.\u201d<\/p>\n

Tipton\u2019s Reins Act bill attempts to address the federal regulatory rule-making trend he sees as trumping the more fair legislative process. The bill has passed the House, but has not moved in the Senate.<\/p>\n

Tipton said the EPA\u2019s proposed Clean Power Plan is another form of overreach by the federal government. The rules would limit emissions of carbon dioxide and greenhouse gases from coal-fired and natural gas power plants.<\/p>\n

This week the U.S. Supreme Court stayed the implementation of the Clean Power Plan rules, possibly putting the regulations in jeopardy.<\/p>\n

\u201cWe can mine, drill and produce energy responsibly,\u201d he said. \u201cThese jobs are important. When businesses have to implement certain regulatory policies those costs are passed on. The net take-home pay of the worker is eroded due to the silent taxes of over regulation.\u201d<\/p>\n

Another Tipton-sponsored bill is the Healthy Forest and Wildfire Prevention Act, which would allow states to get more involved in management of national forests.<\/p>\n

\u201cWe need to timber out over populated areas of trees and undergrowth,\u201d he said. \u201cIn my estimation our county commissioners should be involved in identifying areas of imminent threat, to expedite the process and get in to treat the forest.\u201d<\/p>\n

On trade, Tipton said U.S. agricultural exports \u201care a bright shining spot\u201d and need a fair deal under the pending Trans Pacific Partnership trade agreement. He said for the first time, members of Congress have the opportunity to read the agreement before it moves forward.<\/p>\n

\u201cThe devil is in the details,\u201d Tipton said. \u201cWe need to open up those agricultural markets and get a good deal for American agricultural products.\u201d<\/p>\n
