{"id":105379,"date":"2016-04-29T23:31:23","date_gmt":"2016-04-30T05:31:23","guid":{"rendered":"https:\/\/dh.durangoherald.com\/tj\/republican-keyser-makes-ballot-after-court-challenge\/"},"modified":"2016-04-29T23:31:23","modified_gmt":"2016-04-30T05:31:23","slug":"republican-keyser-makes-ballot-after-court-challenge","status":"publish","type":"post","link":"https:\/\/dh.durangoherald.com\/tj\/republican-keyser-makes-ballot-after-court-challenge\/","title":{"rendered":"Republican Keyser makes ballot after court challenge"},"content":{"rendered":"\n<p><!-- gallery:5332b8ae-adfe-49fb-85f6-9874e053ecae --><\/p>\n<p>DENVER \u2013 Republican U.S. Senate candidate Jon Keyser will be on the June primary ballot.<\/p>\n<p>A Denver District Court ruled that petition signatures excluded by the secretary of state\u2019s office should be considered valid.<\/p>\n<p>Meanwhile, two other candidates \u2013 Colorado Springs businessman Robert Blaha and former Aurora Councilman Ryan Frazier \u2013 were granted a five-day extension to challenge a similar decision by the secretary of state\u2019s office to invalidate signatures.<\/p>\n<p>The issue for Keyser revolved around a signature gatherer who failed to update his voter registration with a new address. The petition circulator moved just days before he started gathering signatures for Keyser.<\/p>\n<p>\u201cIn assessing Mr. (Tyler) Gonzalez\u2019s credibility and the evidence in this case, the Court finds that Mr. Gonzalez did not have an improper motive in failing to update his voter registration address,\u201d Judge Elizabeth Starrs said in a written ruling.<\/p>\n<p>Judges often point out that the law should be \u201cliberally construed\u201d when deciding whether to place a person or issue on a ballot. The idea is to give voters a chance to weigh in, rather than exclude them from the process.<\/p>\n<p>Keyser, a former state lawmaker from Morrison, needed 1,500 valid signatures from Republican voters in each of the state\u2019s seven congressional districts.<\/p>\n<p>On Monday, the secretary of state\u2019s office said Keyser came up 86 signatures short in the 3rd Congressional District, which includes La Plata County.<\/p>\n<p>The campaign for the 34-year-old combat veteran, who lived in Durango and Bayfield as a child, wasted no time attacking the incumbent Democrat he hopes to challenge.<\/p>\n<p>\u201cIt\u2019s a shame for Senator Michael Bennet that the best days of his campaign will be remembered as the few days he falsely dreamed Jon Keyser was blocked from the ballot,\u201d said Keyser spokesman Matt Connelly.<\/p>\n<p>Meanwhile, the campaigns for Blaha and Frazier filed a joint petition on Friday, asking a Denver District Court to block the secretary of state\u2019s office from setting the ballot. Colorado law required the office to set the ballot by Friday.<\/p>\n<p>The court granted the request, giving the two candidates until Wednesday to protest the secretary of state\u2019s insufficiency decision. At that time, the ballot will be finalized.<\/p>\n<p>Staff for both campaigns were combing through petitions at the secretary of state\u2019s office on Friday to determine whether a protest would be worthwhile.<\/p>\n<p>Blaha fell short in three congressional districts, and Frazier in four districts.
